Method of Sale We are instructed to offer the land by private treaty inviting offers for the whole or in two lots with the intention of achieving exchange of contracts as soon as possible with completion two weeks thereafter.

Location The land at Moat Farm lies just to the north of the historic market town of Framlingham and is located within the parish of Badingham.  

Description and Lotting The property comprises a productive block of arable land in two enclosures. In total the arable land extends to 41.54 acres (16.81 ha) and is shown for identification purposes outlined red on the enclosed plan. The land is shown as Grades 2 and 3 under the former MAFF Land Series Classification map. The soil is of the Hanslope (411d) Association being a chalky till, slowly permeable with clayey soils suitable for winter cereals and grassland. It is understood that the land is drained, however, there are no drainage plans available.

The arable land has been farmed under a contract farming arrangement for many years in a white straw rotation. The outgoing contractor will cultivate the land this autumn with the Purchaser reimbursing the contractor upon completion for operations undertaken.

The woodland, known as Oak Grove, extending to 5.15 acres (2.08 ha) is an attractive area of amenity woodland offering the Purchaser enhanced sporting opportunities on the land. There is a small area of overgrown scrub/woodland extending to 0.30 acres (0.12 ha) that could be enhanced by a Purchaser.

The property is sold subject to and with the benefit of all rights of way, wayleaves and easements that may affect the land. There is a public footpath through the arable land and woodland running in an east-west direction.  

Timber, Sporting and Minerals All sporting rights, standing timber and mineral rights (except as reserved by statute or to the crown) are included in the sale of the freehold. The Vendor will retain and exercise the sporting rights until 1st February 2018.  

Boundaries The vendor shall not be required to define the boundaries on the ground. These are shown for identification purposes only outlined red on the enclosed plan. Purchasers should satisfy themselves with regard to these and no error, omission or misstatement will allow the purchaser to rescind the contract nor entitle either party to compensation thereof.

The property is not currently registered with the Land Registry. 

Town and Country Planning The property is sold subject to any development plans, tree preservation orders, ancient monument orders and Town and Country schedules or other similar matters that may be or come into force. 

Outgoings The land is sold subject to any drainage rates and other outgoings that may be relevant.  

VAT Should any sale of the land or any right attached to it become a chargeable supplier for the purpose of VAT, such VAT shall be payable by the purchaser in addition to the contract price. 

Quotas and Basic Payment Scheme The land is registered under the Basic Payment Scheme and 16.81 ha of Normal Entitlements will be made available and transferred to the Purchaser of the land.

The Vendor will retain the Basic Payment income from the 2017 claim. The Purchaser will indemnify the Vendor in respect of all action, cost, claims and demands in connection with any failure on the part of the purchaser to comply with Cross Compliance requirements in respect of the 2017 scheme year. There are no other quotas with the land. 

Environmental Stewardship Scheme The land is not entered into an Environmental Stewardship Scheme.
