The land to the south of Claydon Lane is a rectangular piece of level arable land extending to 19.12 acres (7.74 ha) or thereabouts, shown edged red on the plan and has been farmed through an agreement with H J Spencer & Sons under an arable rotation of wheat and oats.
The land to the north of Claydon Lane is shown edged blue on the plan and extends to 11.53 acres (4.67 ha) or thereabouts and lies between the disused railway line and the new Banbury to Warwick railway line with access from the highway through a field gate via a short access over the old railway line.
Access to three fields of pasture, amenity and scrubland lying to the south of the Oxford Canal is taken via the vendor’s retained land off Claydon Lane along the same route as the bridleway. The land extends to about 20.60 acres (8.34 ha). A gate will be required on the roadside and then through a tunnel underneath the disused railway line into field OS4372 and then over a level crossing (subject to normal Network Rail rules regarding an unmanned crossing) into fields OS5085, 6575 and 7261. The access (15ft wide) will need to be suitably fenced by the purchaser and take into account the bridleway. In the opinion of the agents the land to the north of the railway line has a large amount of amenity and wildlife potential, particularly with the proximity to the Oxford Canal and the current condition of the hedgerows, scrubland and spinneys within this area.
The town of Banbury is approximately 8 miles to the south together with junction 11 of the M40 both accessed via the A423. The market town of Southam is approximately 7 miles to the north via the A423 and further afield, Stratford-Upon-Avon, Leamington Spa, Coventry, Rugby and Daventry are all within easy travelling distance of the land. Vacant possession will be given upon completion which is provisionally set for 29th September 2014. The vendor reserves a right for a holdover period to harvest a crop within field OS8323 if not done so by the completion date.
It is understood that mains water is available but not connected to the arable land and the temporary grass to the north of Claydon Lane it may be available within Claydon Lane if applicable a meter or sub meter will need to be provided by the purchaser upon completion.
None of the above services have been tested and purchasers should note that it is their specific responsibility to make their own enquiries of the appropriate authorities as the location, adequacy and availability of mains services.
Rights of Way
A right of way will be retained by the vendor for access to their retained land over the entrance to Lot 2, on the north of Claydon Lane. Any necessary easements for services will be granted and/or retained. A bridleway runs down the eastern edge of the property to the north of Claydon Lane which will form the access route to the land within Lot 3. Further information can be obtained from Network Rail them in connection with the level crossing, they also benefit from a right of way over Lot 2 to gain access to the railway.
A detailed plan showing the rights will be provided by the selling agents for use within the sales contract and transfer documentation. We are unaware of any other wayleaves, easements or rights of way that may exist over the same whether disclosed or not.
Boundaries & Fencing
The purchaser of Lot 3 will be responsible for fencing and maintaining an access (15ft wide) from the highway as well as a gate. This shall be done within one month of completion.

Single Farm Payment & ELS
The land has been registered to receive single farm payment
entitlements and the vendor has claimed for and reserves the right to retain the 2014 payment. The vendor will transfer the appropriate number of entitlements to match against the land to the successful purchaser(s) in order for the new purchaser to be able to make a claim for these entitlements in the 2015 scheme year.
The purchaser will adhere to the rules of cross compliance until the end of the calendar year in accordance with the current and the proposed new scheme rules for the Basic Payment Scheme. The vendor will transfer over to the purchaser(s) the ELS agreement for the remaining term upon completion and in accordance with rules set out by Natural England. A good faith clause will be entered into between the two parties to ensure that the entitlements and the ELS can be transferred given that the new Basic Payment Scheme introduction is likely to cause some confusion with the RPA.
Sporting, Timber & Mineral Rights
It is believed that sporting, timber and mineral rights are in hand and included within the sale.
The vendor reserves the right to offer the property for sale in any order other than that described in these particulars, to sub-divide, amalgamate or withdraw the property from sale without prior notice.
