Property Description

Full description

Tenure: Freehold

The Property
The site benefits from detailed planning permission for four dwellings.

History of the site
Up until recently, the site formed part of the Jacklin Family Farm. The site was predominately used for the rearing of turkeys. However since this enterprise was discontinued, the remaining working farmyard has been relocated to permit the proposed development which has been carefully considered and designed to enhance the character of this area of the village.

In order to protect the amenity of the eventual owners, the site will have controls in relation to any alterations on site without the prior permission from the sellers who live on the frontage in the Old Shop and other owners should the property be sold in lots. Any changes to the external appearance or frontage of the dwellings will be subject to that approval process.

In order to satisfactorily deal with the road and services a costed proposal is being prepared to firstly discharge the conditions on the planning permissions and then construct the roadway to a satisfactory standard and the water, foul drainage and electricity services.

It is intended that the first purchaser will enter into a conditional contract with the seller to have the roadways and services installed for the property after exchange of contracts subject to any mortgager requirements. The seller will then undertake to deliver the agreed scope of the works within an agreed timescale. Other arrangements which may suit the buyer better would be considered as well.

Shared driveway
The ownership of the drive will be that lot 3 will own the drive and the remaining lots and retained property will have an unencumbered right of access at all times and for all purposes and maintenance of the road will be according to user.

Fencing
LOT 2:
The buyer will be responsible for erecting and forever after maintaining a Lincolnshire Post and Rail and Hawthorn hedge as a boundary fence with the adjoining boundary to Lot 3.

The remaining boundaries will be the buyer(s) responsibility but will be Lincolnshire Post and Rail and Hawthorn hedge.

Services
The seller will retain the existing service connections and all 3 lots will therefore require new water, drainage and electricity connections. Please see planning and infrastructure above.

Wayleaves, Easements, Covenants, Conditions and Rights of Way
The land is sold subject to and with the benefit of all existing wayleaves, easements and rights of way, whether mentioned in these particulars or not.

The sellers are particularly anxious to preserve the character of the location for the benefit of all residents and will therefore impose the following restrictive covenants into the sale contract:
(a) Not to cause noise and nuisance or disturbance to the sellers retained land.
(b) Not to carry out any development other than the approved scheme without prior approval from the sellers of their successors in title, such consent not to be unreasonably withheld or delayed.
(c) Not to use the buildings or land for any purpose other than residential unless the prior approval of the sellers or their successors in title is granted.
(d) Not to keep any caravan or vehicle adapted or intended for use as a dwelling or sleeping accommodation or boat or trade vehicle on the property unless the same are stored in the garage.

Tenure
All the property is offered for sale freehold with the benefit of vacant possession upon completion.

Viewings
Strictly by arrangement through the selling agents.

VAT
It is not anticipated that VAT will be charged, however should any sale of any part of the land or any rights attached to it become chargeable supply for the purpose of VAT, such tax will be payable by the buyer(s) in addition to the contract price.
