Full details of the restrictions are set out in section 106 Planning Obligation deed dated 23rd September 2013 between the developer and the Peak Park Authority. A brief summary of those provisions is set out below.

The first occupier of each of the 6 houses must satisfy the Local Qualification Provisions of the deed AND be able to demonstrate a Proven Need for Accommodation.

A - Local Qualification Requirement - To Satisfy this the prospective occupier must be a person who: i) has lived in the parish of Birchover (or one of the adjoining parishes of Elton, Harthill, Stanton-in-the-peak, South Darley or Winster) for a minimum of 10 years out of the last 20 years; or
ii) has an essential need to live close to their work in one of those parishes; or iii) has an essential need to live close to another person who has lived in one of the parishes for at least 10 out of the last 20 years as a result of that persons age and/or infirmity.

B - Proven Need For Accommodation - A person having a proven need for accommodation is one who: i) is presently living in overcrowded or otherwise unsatisfactory accommodation; or ii) is setting up a household for the first time and their need for accommodation cannot be met by other housing available in the area at a similar price.

If any of these properties still remain available 3 months from first being advertised then the residency period in a) above can be relaxed to allow them to be occupied by a person who has 5 years residency within the last 20 years, rather than 10 years.
If any properties still remain 4 months from first being advertised then they can be made available to a person who has at least 10 years residency within the wider area of the Peak District National Park.
Finally, after 6 months, the qualifying area can be expanded to include parishes adjoining the Peak District National Park boundary.
