Planning Consents - Full planning consent (TWC/2015/0255) approved "erection of 4 terraced dwellings and erection of 6 apartments following demolition of Adamson House with associated parking and landscaping" on 28th October 2015 subject to 11 conditions. The Section 106 Agreement requires payment of £4200 towards off site play space. There is no affordable housing contribution. This area relates to Phases C and D.

Phase E is within the development boundary and it currently contains two large industrial buildings so it is a brownfield site. A pre-application enquiry has been submitted and discussions have commenced with positive feedback from the Council. An outline application for 19 houses (part two, part three storey) will be submitted imminently. Phase A is almost complete with seven unique "town" houses (six sold). Plan B has commenced for eight "town" houses.

Boundaries - The Vendor will erect a boundary demarcation around Phase B, apart from against the woodland. The Purchaser shall be deemed to have full knowledge of the boundaries. Neither the vendor or agent will be responsible for defining boundary ownership.

Rights Of Way - Horsehay Estate currently owns the freehold interest of Phases B to E. It is currently developing Phase B. The vehicular access through the large steel gates onto Bridge Road will serve all phases. There may be potential to create an access from Frame Lane into Phase E. All dwellings will have the right to access the communal woodland. In Phase B.

Easements And Covenants - The property will be sold subject to any wayleaves, public or private rights of way, easements and covenants whether mentioned in these sales particulars or not.

Sale Conditions - The sale is subject to:-

1. The Purchaser fully complying with all Planning Conditions and the Section 106 Agreement relating to TWC/2015/0255 and activating it before it expires.

2. The Purchaser demolishing all necessary buildings to facilitate the development.

3. The Purchaser complying with the proposed Heads of Terms prepared by Halls dated 1st August 2016. The sale of Phases C and D are not to be conditional upon planning. Sale of Phase E is anticipated to be conditional upon obtaining planning consent. The Vendor is happy to consider an unconditional sale of all phases.

4. The Purchaser shall make its own investigations into ground conditions and services.

5. The Vendor will provide vacant possession of each Phase prior to development commencing. The occupiers of the commercial buildings in Phase E are on short term leases.
