Newton Grove Farm is being offered to rent on a Farm Business Tenancy commencing on 29th September 2016 after having been farmed by the Bath family for over 50 years. The farm comprises a medium loam and overlies clay.
The land has been cropped with a rotation of cereals and Oil Seed Rape for some years. The land is identified as grade 2 on the agricultural Land Classification Map of the area. The soil is identified as Stagnogleyic Brown calcareous earth of the Cannamore series and is identified on the Geological Drift Map as overlying Boulder Clay.
The farm comprises 5 arable fields amounting to 41.26ha (101.95 acres).
The farm benefits from good road frontage and access.
BASIC PAYMENT SCHEME
The Landlord has submitted the 2016 claim and will reserve all income from the 2016 claim. The Landlord will transfer to the Tenant 41.26 entitlements. At the end of the tenancy the Tenant(s) will transfer back all entitlements, at no cost, to the Landlord or his nominee.
The successful Tenderer will not do anything on the land which will jeopardise the 2016 Basic Payment Scheme and will undertake to fully cross comply with the RPA scheme and will indemnify the Landlord against any loss of Basic Payment Scheme or other costs associated therewith incurred by the Landlord by the failure to observe such obligations.
NITRATE VULNRABLE ZONE
The farm is designated as being within a Nitrate Vulnerable Zone. The incoming Tenant(s) will be required to adhere to all NVZ regulations.
RIGHTS OF WAY
The Landlord will reserve rights of way over all tracks included within the Farm Business Tenancy.
A public footpath runs east/west through the farm and also east/north.
A plan of which shall be available to view on the viewing days.
WAYLEAVES & EASEMENTS
The Landlord will retain all wayleave and easement payments as they affect the farm.
Environment Agency General Drainage Charge currently £2.0364 per hectare (2016/ 2017) will be payable by the Tenant.
SPORTING & TIMBER RIGHTS
All sporting and Timber rights will be reserved to Landlord.
The land is to be let under a Farm Business Tenancy and the requisite Notices will need to be exchanged prior to the letting. The Tenancy will make provision for the following matters amongst others:-
a) The tenancy will be granted to an individual who will be personally responsible for farming the land (either on his own account or as a partner or Director of a farming business).
b) The Tenancy will commence on 29th September 2016 for a term of 3 years
c) Rent to be payable in two equal instalments per annum in advance, the first payment to be made on 29th September 2016 and subsequent payments on 25th March and 29th September in each year.
d) The rent will be fixed for the initial 3 year term.
e) The Tenant will be required to crop the holding, in accordance with Cross Compliance standards. No Genetically Modified or Maize crops are to be grown on the holding. No root crops are to be grown on the holding in the last year of the tenancy.
f) Incoming Tenant is to hold suitable public liability insurance.
h) The Tenancy is let on a full repairing Tenancy. The Tenant will be required to cut hedges at least once during any 2 year period.
i) The Tenant will be required to farm the land in accordance with the rules of good husbandry and to undertake routine maintenance. In particular to ensure the soil indices at the end of the tenancy are with the range for fertile land within the district.
j) There will be no tenant right payment to the ingoer and there will be no right for the ingoer to receive dilapidations, if any.
k) The Tenant shall not be able to assign or under-let or share possession of the land.
l) The Tenant will be required to use the land solely for agricultural purposes.
m) The Landlord will reserve the right to resume possession on part of the holding on which planning consent is granted, Subject to serving 12 months´ notice.
The successful Tenderer will be permitted to take early entry in order to prepare for the 2017 crop following removal of the 2016 crop at their own risk. If early entry is taken the Tenderer will indemnify the owners for any breach of Cross Compliance Standards under the Basic Payment Scheme.
RECORD OF CONDITION
Prior to entry a photographic record of condition will be taken of the farm, including tracks, together with soil sampling of the fields.
The Landlord reserves the right to charge VAT on the Tenancy. Rent for the farm is not currently subject to VAT.
The land may be viewed during daylight hours with a set of these particulars to hand. There will be a representative from the selling agents present on site on the following viewing days:-
