DIRECTIONS From South Milton village, take the road toward Thurlestone. Proceed along this road for about 1 mile and the entrance to the land will be found between the residential properties located on the left hand side, on the approach to Thurlestone Sands. 

DESCRIPTION Extending to a total of some 10.07 acres (4.08 hectares), the full extent of the land is as approximately outlined in red on the site plan.

The land is available for sale as a whole or in two lots (6.03 acres and 4.04 acres), to suit purchaser's requirements.

With a combination of gentle and moderate south and west facing slopes, the land is currently down to grass, having been used previously for accommodating livestock and for grass conservation purposes, but also has arable potential.

The land is bordered on the north and west by existing residential properties, on the east by other agricultural land and on the south side by a nature reserve. 

WATER SUPPLY There is currently a metered mains water supply to a cattle drinking trough, as approximately indicated on the plan by the letters 'WT'.

In the event that the land is sold in two lots, then the seller will undertake to install a further mains water supply, such that both of the lots will each have a mains water supply.  

RIGHTS OF WAY There are no public rights of way across the land. 

FENCING In the event that the land is sold in two lots, then the seller will undertake to erect a standard agricultural stock-proof fence between points A and B (as approximately shown on the site plan), within three months following legal completion. This fence to be a party boundary thereafter. 

OVERAGE CLAUSE The land is being sold subject to an Overage Clause at a rate of 20% and to apply for a period of 25 years from the date of legal completion, whereby any buyer obtaining planning consent for residential development, within the 25 year period, will be required to pay the seller (or their successors in title), on granting of the consent, a sum of 20% of the increase in value attributed to the land as a result of gaining any such consent. 

ACCESS Currently the access to the land between the residential properties, Tolcarne and Patchways Cottage, is reasonably wide and in the event that the land is sold in two lots then this access would be owned by Lot 1, while Lot 2 would have a right of way over it for all purposes at all times. The purchaser of Lot 2 will be required to contribute towards the maintenance of this track according to use.

In the event that the land sells in two lots, the seller will undertake to install two gates where the access track meets the field, to provide separate access to each of the lots.

Please note that Tolcarne and Patchways Cottage have a right of way over this access to the land, for the purposes of gaining access to the side of their properties.  

METHOD OF SALE The land is being offered for sale by Informal Tender, with a closing date of 12 noon on Friday, 15th September 2017.
