Community Infrastructure Levy (CIL) The two proposed new dwellings will be subject to the Community Infrastructure Levy (CIL). Proposed Contractual Obligations and Covenants The purchaser of the site will be obliged to erect new boundary treatments and gates enclosing The Firs. The exact detail of the fencing is to be agreed with the vendor of The Firs, but will be to a minimum of 6ft close boarded fencing with concrete posts and gravel boards. The boundary treatment/fencing will need to be constructed within 6 months of the sale completing.
The purchaser of the plots will be obliged to install the shared driveway, with the owner of The Firs, and their successors in Title, benefitting from a full right of way over it, together with the right to connect into any services within it. The owner of The Firs will be obliged to contribute towards any future maintenance and upkeep of the shared drive.
The sale contract will also include a provision stating that the proposed dwellings must be completed within 24 months of the sale of the site completing. The vendor will also include a covenant to ensure that only two dwellings are built on site.
