A copy of the planning consent can be viewed on the Harborough District Council website and it should be noted that the lessor will be responsible for complying with the conditions which are included below.

Condition (1) - The A3 Use and building or other operations hereby permitted must begin within a period of 3 years starting with the prior approval date at the top of this Decision Notice letter.

Condition (2) - The change of Use from A1 Use to A3 Use shall not commence on site until full details (including details of noise attenuation) of ventilations and filtration equipment to suppress and disperse any fumes and/or smell created from the cooking operations on the premises have been submitted to and approved in writing by the Local Planning Authority. The A3 Use shall not commence until the equipment has been installed in accordance with the approved details and, thereafter, it shall be maintained as such in perpetuity. REASON: In the interests of visual amenity (the character and appearance of the building, site and surrounding Conservation Area and to safeguard neighbouring amenities, which includes residential properties in close proximity.

Condition (3) - The premises shall not be used for the permitted A3 Use other than between the hours of 09:00 and 23:00 Tuesday to Thursday, 09:00 and 24:00 Fridays and Saturdays and at no time on Sundays and Bank/Public Holidays. REASON: to safeguard neighbouring amenities, which includes residential properties in close proximity.

Condition (4) - Any external extraction flue/s, pipes or fitments shall be finished in black, unless otherwise agreed in writing by the Local Planning Authority. REASON: In the interests of visual amenity (the character and appearance of the building, site and surrounding Conservation Area.

Use - The premises can be used for A1 or A3 uses. There will be a covenant in the lease which prevents the premises being used as a dress shop, post office, hairdresser, beautician, book shop or estate agent. This clause is included to protect the landlord's other properties which are used for the aforementioned.

Lease - A new lease will be granted on Full Repairing and Insuring Terms for a term to be agreed at a rent of £25,000 per annum exclusive with rent reviews every three years. The incoming tenant will be responsible for paying the landlord's reasonable costs for preparing the agreement. There are some storage heater which it is likely that any tenant would remove. The landlord does not warrant that the heaters work and will take no responsibility for them
