Description

7 Dwelling Building Plot on 0.75 acres (approx.) with Full Planning Permission in Perpetuity and 1.85 acre (approx.) adjoining field

Opportunity to acquire a building plot in Goldsithney with planning obtained via an Appeal in 2009 for the conversion of the existing building to form 5 houses and 2 flats.

The Site
Approximately 0.75 acre plot with full planning permission in perpetuity for the redevelopment of the existing building to create 7 dwellings of five 3 bed houses which are semi-detached and two 2 bed flats.

Planning
Application granted 1/90/P0503 for the alterations and conversion to 8 flats and connection to sewer and improvements to Gears Lane at the Museum of Mechanical Music was approved on 2th July 1990.
A revised planning application was refused 04/P/1051 for 7 residential units which was submitted in July 2004. This was to change the design of the flats as part of the general approved scheme to decrease the number from 8 to 7, raise the roof height on flat 1, house 1,2 and 4 by 450mm.
Appeal APP/L0825/A/05/1181372 in January 2006 for application 04/P/1051 was determined as approved subject to conditions in November 2004.
A letter from Cornwall Council dated 2nd October 2009 sent to the Vendor following a site visit states “ As you know, the Council in its letter dated 27th July 2009 confirmed the details required under conditions 3 and 7 of this permission, which you have submitted, were agreed so that the development could lawfully be begun. The permission’s condition 1 required the commencement to occur before 30th November 2009. Having regard to Section 56(4)(a) and (c) of the Town and Country Planning Act 1990 (as amended), it is considered that these works constitute a lawful commencement of the development granted by planning permission ref. 04/P/105, and there is no set time limit for completing the scheme.
