From 1 May 2026, changes under the Renters\u2019 Rights Act mean private renters will have stronger rights and clearer rules around tenancies and rent. This includes things like periodic tenancies rather than fixed term, limits to rent in advance, and when and how rent is paid.<\/p>\n\n\n\n<p>This guide explains what to expect before you move in, what information you should receive, and how paying rent works under the new system.<\/p>\n\n\n\n<h2 id=\"what-type-of-tenancy-will-i-have\" class=\"wp-block-heading\">What type of tenancy will I have?<\/h2>\n\n\n\n<p>From 1 May 2026, private renters in England will have an assured periodic tenancy.<\/p>\n\n\n\n<p>This means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your tenancy will roll on from month to month (or week to week)<\/li>\n\n\n\n<li>There is no fixed end date, even if you previously signed a fixed\u2011term contract<\/li>\n\n\n\n<li>Existing assured shorthold tenancies (previously known as ASTs) will automatically convert to this new type of tenancy<\/li>\n<\/ul>\n\n\n\n<p>You don\u2019t usually need to sign a new agreement for this change to take effect.<\/p>\n\n\n\n<h2 id=\"do-i-still-get-a-tenancy-agreement\" class=\"wp-block-heading\">Do I still get a tenancy agreement?<\/h2>\n\n\n\n<p>Yes. While tenancies no longer have a fixed term, landlords must still provide clear written information about your tenancy.<\/p>\n\n\n\n<p>This will usually be in the form of a tenancy agreement and must set out:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who the landlord is<\/li>\n\n\n\n<li>How much rent you pay and how often<\/li>\n\n\n\n<li>How rent increases work<\/li>\n\n\n\n<li>Your responsibilities, and the landlord\u2019s responsibilities<\/li>\n<\/ul>\n\n\n\n<p>If you already have a written agreement, your landlord must give you a government\u2011produced information sheet explaining how your tenancy has changed under the new law.<\/p>\n\n\n\n<h2 id=\"when-do-i-need-to-pay-rent\" class=\"wp-block-heading\">When do I need to pay rent?<\/h2>\n\n\n\n<p>Under the Renters\u2019 Rights Act, there are new rules about when rent can be paid.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your landlord cannot ask for or accept rent before you\u2019ve signed the tenancy agreement<\/li>\n\n\n\n<li>Once the agreement is signed, they can ask for a maximum of one month\u2019s rent in advance<\/li>\n\n\n\n<li>Rent is then paid on a regular basis, usually monthly<\/li>\n<\/ul>\n\n\n\n<p>These rules are designed to prevent renters being asked for large upfront payments before a tenancy is confirmed.<\/p>\n\n\n\n<h2 id=\"can-a-landlord-ask-for-more-than-one-months-rent-upfront\" class=\"wp-block-heading\">Can a landlord ask for more than one month\u2019s rent upfront?<\/h2>\n\n\n\n<p>No. From 1 May 2026:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Landlords and agents cannot require more than one month\u2019s rent in advance<\/li>\n\n\n\n<li>Rent cannot be taken before the tenancy agreement is signed<\/li>\n\n\n\n<li>Any rent requested outside these rules is considered a prohibited payment<\/li>\n<\/ul>\n\n\n\n<p>This applies even if a renter offers to pay more upfront.<\/p>\n\n\n\n<h2 id=\"how-is-rent-usually-paid\" class=\"wp-block-heading\">How is rent usually paid?<\/h2>\n\n\n\n<p>Rent is normally paid by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Standing order<\/li>\n\n\n\n<li>Bank transfer<\/li>\n<\/ul>\n\n\n\n<p>Your tenancy agreement should clearly state:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The rent amount<\/li>\n\n\n\n<li>When it\u2019s due<\/li>\n\n\n\n<li>How it should be paid<\/li>\n<\/ul>\n\n\n\n<p>Keeping a record of payments can help avoid misunderstandings later on.<\/p>\n\n\n\n<h2 id=\"can-my-landlord-increase-the-rent\" class=\"wp-block-heading\">Can my landlord increase the rent?<\/h2>\n\n\n\n<p>Rent increases are more tightly controlled under the new rules.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Rent can usually only be increased once a year<\/li>\n\n\n\n<li>Landlords must use a formal notice and give at least two months\u2019 notice<\/li>\n\n\n\n<li>You can challenge an increase if you think it\u2019s excessive<\/li>\n<\/ul>\n\n\n\n<p>Your agreement should explain how rent increases work in practice.<\/p>\n\n\n\n<h2 id=\"what-if-something-isnt-clear-in-my-tenancy-agreement\" class=\"wp-block-heading\">What if something isn\u2019t clear in my tenancy agreement?<\/h2>\n\n\n\n<p>Before you sign anything, make sure you understand:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>How much rent you\u2019ll pay<\/li>\n\n\n\n<li>When payments start<\/li>\n\n\n\n<li>What happens if you want to leave<\/li>\n\n\n\n<li>What notice your landlord must give<\/li>\n<\/ul>\n\n\n\n<p>If anything is unclear, ask the landlord or letting agent to explain it in writing.
