Much has not been said about the assignment of Golden Visas (Golden Visas). But what, in fact, are these seen? Who can get them? With what end? What conditions? Below, we make a brief explanation about them, so you know for sure what is at stake when it comes to granting Golden Visas
What is a Golden Visa
Golden Visa has the technical name Residence for Investment Activity (ARI), a scheme that allows foreign citizens to obtain a temporary residence permit for investment activity with the exemption of residence visa to enter the country. This investment activity can be consummated in three ways:
- Transfer of capital of EUR 1 million or more
- Creation of at least ten jobs
- Acquisition of immovable property worth 500 thousand euros or more (it is in this situation that we are going to focus)

What benefits do foreign investors have?

You can:
- Enter Portugal with a residence visa waiver
- To reside and work in Portugal, being able to maintain another residence in another country
- Circular through the Schengen area, without visa
- Benefit from family reunification
- Access to permanent residence (after five years and in accordance with the legislation in force)
- Access to Portuguese nationality (after six years and in accordance with current legislation)

Who can get a Golden Visa?

All nationals of third countries - not belonging to the European Union (EU) and the European Economic Area - who carry out an investment activity on a personal basis or through a company incorporated in Portugal or in another EU state and having a permanent establishment in Portugal .

What are the personal requirements you need?

- No conviction for a crime that in Portugal is punishable by deprivation of liberty for more than one year
- Not be prohibited from entering the national territory, following a measure of removal from the country
- No indication in the Schengen Information System
- No indication in the SEF Integrated System for non-admission purposes

What about documentary requirements?

- Have a valid passport
- Have a Schengen visa, if applicable, and regularize the situation with the SEF within 90 days of the date of first entry into Portugal
- Have a criminal record of the country of origin or the country where you have lived for more than one year
- Have a declaration authorizing consultation of the Portuguese criminal record
- Have an updated negative debt declaration issued by the Tax and Customs Authority and by social security
- Declare, on a commitment of honor, that it will comply with the requirements of the investment activity in national territory
- Have proof of health insurance
- Have proof of payment of the analysis fee of the ARI application (€ 513.75)

On the acquisition of real estate of value equal or superior to 500 thousand euros

What does the applicant have to do with Golden Visa?

- Acquisition or promise of purchase of the real estate where the declaration of a financial institution authorized to the exercise of its activity in the national territory, attesting the effective transfer of capital for its acquisition or for effecting sign of promise of purchase in value equal to or greater than 500 thousand euros
- Up-to-date certificate from the land registry office, which must always include, in the case of a contract-promise and whenever legally viable, its registration

How can the property be acquired?

- Under a joint ownership scheme, provided that each co-owner invests a value equal to or greater than 500 thousand euros, or by means of a promise-of-purchase contract, with a signal equal to or greater than 500 thousand euros, and must present before ARI renewal the respective acquisition title
- Can be charged (mortgage, for example) from a value higher than 500 thousand euros
- May be leased or exploited for commercial, agricultural or tourist purposes

What are the obligations arising from the assignment of Golden Visas?

- The minimum time requirement of five years for the maintenance of investment activities is counted from the date of granting the residence permit
- The minimum periods of stay are: seven days, followed or interpolated, in the first year; 14 days, followed or interpolated, in the subsequent periods of two years
