The land can also be accessed off the A19 via Howden Lane at Crockey Hill and also from Lingcroft Lane adjacent to the Persimmon PLC offices.

Tenure - The freehold of the farmland is offered for sale with vacant possession following Harvest 2022. A strip of land lying adjoining the B1222 in the north west corner of field 3614 is owned by the City of York council. The strip is not fenced off and has been farmed by the vendors however there is no written agreement nor rent paid.

Subsidies & Grants - The farmland is not entered into any Stewardship Agreements but is registered for receipt of BPS payments. Entitlements based on the net eligible area are included in the sale and will be transferred to the purchaser following completion. Payments relating to the 2022 will be retained by the vendors.

Rights of Way, Easements & Wayleaves - The land is sold subject to, and with the benefit of all existing wayleaves, easements and rights of way, public and private whether specifically mentioned or not. There are no public footpaths over the land however there was a right of way on foot reserved to previous owners along the track to the west, south and eastern boundaries of fields 7307 and 9820. The vendors will reserve rights of access on foot to walk the farm tracks. The land benefits from vehicular right of way along Lingcroft Lane to the land. Vehicular rights of access will be retained from Naburn Lodge Farmhouse, cottages and buildings along the farm track to Lingcroft Lane. Rights of Way will be granted along the main driveway and through the farmyard for 12 months following a completion.
Overage - Field numbers 5413, 3614, 7307, 9820 and 0999 will be sold subject to Overage of 30% of any uplift in value as a result of grant of any planning consent for non agricultural use, for period of 35 years from the date of completion of the sale. Field numbers part 9820, part 7307and 0999 are already subject to a 50% Overage in favour of a previous owner until 2033.
Boundaries - The farmland adjacent to Naburn Lodge Farmhouse, cottage and buildings which is excluded from the sale (see plan) as well as approximately 12 acres at the north east corner of 9820 will be available to the purchaser on an FBT until such time as it is fenced off by the vendors.

Irrigation - The land is sold with the benefit of an Environment Agency Irrigation Licence (2/27/24/212) which permits the abstraction of water for spray irrigation purposes between the 1st May and 31st August to a maximum of 30,450 cubic meters per year. There are abstraction points from the River Ouse and from Howden Dyke and rights of access will be granted as appropriate.
