respectively be owner or owners of the land or the part thereof in respect of which any breach occurs
THE SCHEDULE before referred to
1. No building of any kind other than dwellinghouses with appropriate offices garage and outbuildings appurtenant thereto and occupied therewith shall be erected on the said plots of land and every such dwellinghouse shall be wholly or semi-detached No dwellinghouses or other building or erection shall be erected on the said plots of land until the plans and estimated costs of the buildings to be erected have been submitted to and approved in writing by the Vendor and no dwellinghouses buildings or erections shall be roofed with asbestos or material other than earthenware or french tiles without the consent in writing of the Vendor
2. No dwellinghouse or building shall be erected in the case of a semi-detached house nearer than four feet to the boundary of the plot on one side thereof nor in the case of detached houses nearer than four feet to the boundary on either side of the said plot Provided that this condition shall not be deemed to prohibit the erection over such space of Four feet of a garage but such garage shall not exceed Eight feet six inches in height and shall be flat roofed
3. No trade or business shall be carried on upon any of the said plots of land or in or upon any dwellinghouse or building erected thereon but this condition shall not apply to the area on the estate designated by the Local Planning Authority as a shopping area
4. No dwellinghouse or building shall be used as a club
5. Nothing shall be done or suffered to be done in
or upon the said dwellinghouses or buildings which shall be or grow to be a nuisance or annoyance to the Vendor its successors and assigns or to the owners or occupiers of adjoining property
6. The Purchasers shall erect proper fences on the boundaries of the plot or plots of land conveyed to them All fences between the building line and the road boundary shall be ornamental wood fences green privet hedges or such other fences as shall be approved by the Vendor such fences shall not exceed four feet six inches in height All other fences (except where the house end wall forms part of the boundary) shall be green privet or other live hedges or other fences to be approved by the Vendor and shall not without the consent of the Vendor and adjoining owners exceed Four feet six inches in height
7. The division fences between plots shall be party fences and the costs of such fences shall be borne by the Purchasers and the owner of the adjoining land in equal shares the owner or owners for the time being of such adjoining land shall pay to the person or persons providing such party fences and his her or their executors administrators or assigns half the cost thereof and the same shall be and is hereby made a charge upon such adjoining land into whosesoever hands or ownership it may be and shall be payable as soon as the owner for the time being of such adjoining land shall commence to make use of the said party fences But in case such adjoining owner or owners for the time being shall not commence to build or make use of the said party fences within a period of three years from their being planted or erected such owners shall at the expiration of that time pay on demand a moiety or half part of the cost of the end house wall and the division fences and in case of dispute as to the amount payable the same to be settled by a Surveyor appointed by the Vendor
8. No trees or shrubs in front gardens shall be allowed to exceed eight feet in height and no forest trees shall be planted
