1. A servitude right of pedestrian and vehicular access from the public road over the access road tinted brown on the Title Plan, subject to an obligation on behalf of the Disponee to maintain, repair and renew the same on a user basis, but stating that no claim in respect of the said maintenance, repair or renewal of the same may be made against the Estate Proprietor; together also with all existing rights of pedestrian and
vehicular access between those areas of ground forming the subjects in this Title so far as the Estate Proprietor has a right to grant same.
2. A servitude right to use for the water supply, electricity supply, drainage and sewage of the Disponed Property and any buildings and others built, or to be built thereon, all existing water supplies, tanks, pipes, drains, cables, sewers and others on, under, or over any other part of the Retained Property which are at present so used, with rights of access thereto on giving reasonable notice to the Estate Proprietor for  maintenance, repair, alteration or renewal thereof, subject to making good any surface and other damage (including pollution or contamination which could be construed to be a contravention of the trms of the Environmental Acts and the Control of Pollution Act 1974 as amended) that may be caused as the cost thereof shall in the event of dispute be fixed by an arbiter mutually chosen, or appointed by the Sheriff at Dornoch. In the event of surface damage the Disponee shall, without prejudice to the foregoing generality, replace the top soil, plant and reseed the damaged land and repair any agricultural drains and pay compensation to the
Estate Proprietor, or their crofting, or agricultural tenant on demand for the value of any crop loss and/or grazing loss attributable to the exercise of these servitude rights. The Disponee shall so far as possible minimise the inconvenience to the Estate Proprietor occasioned by the Disponee's tenants, agents, employees, workmen and others authorised by them in the exercise of the foregoing servitude rights
