CONDITIONS OF SALE
The highest bidder to be the Purchaser, and if any dispute arises between the bidders the Lot in dispute shall immediately be put up again and re-sold. The Auctioneers reserve the right of refusing the bid of any person and regulating the bidding.
The Purchasers to give their names and addresses in writing (if required), and pay the full purchase money immediately after or during the course of the Sale.
No Lot shall be removed from the premises until paid for, but each and every Lot shall be immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk of a respective Purchaser or Purchasers thereof and shall be removed from the Sale at the Purchasers expense, and taken with all faults and errors of description.
No undertaking by the Auctioneers or their servants to take charge of the Lots or animals after the Sale, or to forward them to their destination, shall be held to impose upon the Auctioneers any legal obligation or vitiate any of the foregoing conditions.
All statements in the Particulars are made on the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements.
In as much as the Auctioneers act as Agents for disclosed principles, they shall not be considered personally responsible for any default on the part of either Purchaser or Vendor, and the remedy shall be against them only and not against the Auctioneers.
Purchasers paying by cheque who are unknown to the Auctioneers will be required prior to the sale to provide a Banker’s Reference. Such References are obtainable by purchasers from their bank and forwarded direct to the Auctioneers.
Lots/goods purchased by unknown parties may be required to remain on the sale premises until cheques have cleared but will remain “the entire risk of the purchaser.”
If any Purchaser shall refuse to settle for any Lot or Lots, or fail to comply with the Conditions of Sale, the said Lot or Lots may be re-sold either by public auction or private contract, and the deficiency, if any, together with all expenses incident to such second sale or sales shall be made good by the defaulters, and shall be recoverable as and for liquidation damages; any increase to go to the Vendors.
The Auctioneers and Vendors reserve the right to withdraw, consolidate or divide any lot or lots or submit them in any order that they deem desirable.
