DIRECTIONS From the centre of Aveton Gifford village, proceed in a northerly direction towards Modbury. Turn right either up Rock Hill or the next turning right (Bakers Hill) and proceed up either of these two roads for about 500 yards and the land will be found on the left hand side or immediately ahead.  

SITUATION Rockhill Field is situated on the east side of the village of Aveton Gifford in the South Hams area of South Devon. The village of Aveton Gifford is situated approximately equidistant between the towns of Kingsbridge and Modbury.

The beautiful South Hams coastline is a short distance away with Bantham and Thurlestone beaches being approximately 4 miles to the south and Bigbury Bay being about 3 miles to the south east.

The larger town of Kingsbridge is about 6 miles to the south and the A38 dual carriageway expressway, connecting to the M5 motorway and national road network, is about 10 miles to the north.  

DESCRIPTION Rockhill Field comprises a pony paddock extending to a total of some 2.49 acres (1.01 hectares), which can be acquired as a whole in its current form or in a combination of lots (as highlighted on the site plan) as may suit purchaser's requirements.

The land has a combination of gentle, moderate and in places steep north, east, south and west facing slopes and offers the potential for alternative uses, subject to obtaining the necessary planning consent.

There is an existing vehicular access off the south boundary, which if sold in a number of lots, will form a shared access area over which all three lots will have a right of access to get to their respective lots. A management agreement will need to be formed to administer the maintenance and management of this shared access area.

There is a further access, albeit quite narrow into lot 1.

WATER SUPPLY The seller undertakes to supply and install a mains water supply to all three lots, within approximately 12 weeks following legal completion (subject to South West Water being able to meet this timescale).

Lot 3 will be responsible for the main meter and the water bill payable to South West Water and sub-meters will be installed for Lots 1 and 2, with Lot 3 to invoice them for water they have consumed at South West Water's prevailing rates. In the event that invoices issued to Lots 1 and 2 are not settled within a reasonable time, then Lot 3 will have the right to disconnect the water supply to those lots. 

OVERAGE CLAUSE Rockhill Field is being sold subject to an Overage Clause at a rate of 30%, to apply for a period of 25 years from the date of legal completion, whereby any buyer obtaining planning consent for residential or commercial development, within the 25 year period, will be required to pay the seller (or their successors in title), on granting of the consent, a sum of 30% of the increase in value attributed to the land as a result of gaining any such consent. 

PUBLIC RIGHTS OF WAY There are no public rights of way across the land, as far as are known.  

SPORTING AND MINERAL RIGHTS All sporting and mineral rights are included in the sale, as far as are known.  

BASIC FARM PAYMENT ENTITLEMENTS The land is registered with the Rural Payments Agency for the purposes of the Basic Farm Payment Scheme, but no entitlements are included with the sale.
