SITUATION The land is situated between the town of Modbury and the village of Aveton Gifford in the South Hams area of South Devon, the respective town and village being about 3 miles and 2.5 miles away respectively. The A38 dual carriageway expressway, connecting to the M5 motorway and national road network, being about 10 miles to the north.

DESCRIPTION Extending to a total of some 58.96 acres (23.86 hectares), the full extent of the land is as approximately outlined in red (Lot 1) and blue (Lot 2) on the Rural Land Register digital map.

The land is for sale as a whole or in two lots (25.00 acres for Lot 1 and 33.95 acres for Lot 2), to suit purchaser's requirements.

The land is reasonably level in part, with the majority occupying gentle south, east and west facing slopes, it all offering the potential for arable cropping purposes. The land in the past has been used for arable farming and grass conservation purposes, but offers the potential for accommodating livestock, or other uses, subject to obtaining the necessary planning consent.

The land is bordered predominantly on the south side by a council maintained highway, leading from Hangmans Cross to Aveton Gifford and the main access to the land would be off this road.

There is also an access over Tongue Lane, on the north boundary and this would form the access for Lot 2, in the event the land was to be sold in two lots. 

FENCING Should the land sell as two lots, then the buyer of Lot 2 will be required to erect a post and rail, with sheep wire attached, stock-proof fence in the north-west corner of field number SX6951 - 8550, where there is an existing gateway into SX 6951 - 6049. This corner would need to be mapped accurately accordingly.  

WATER SUPPLY There is currently no water supply to the land, however an existing underground mains water supply is located in the council highway near Beechy Lane Junction and it would be the buyer's responsibility to enquire about the possibility of connecting into this mains supply, to run a supply then to the land. 

RIGHTS OF WAY There are no public rights of way across the land. 

BASIC PAYMENT SCHEME ENTITLEMENTS The land is registered for the purpose of the Basic Payment Scheme and an equivalent number of entitlements matching the area of land, will be included in the sale of the land. The seller will endeavour to transfer these entitlements to the buyer as soon as possible following legal completion. 

SECTION 106 AGREEMENT There was a Section 106 agreement relating to this land being offered for sale, which has now been discharged by way of a deed by South Hams District Council, a copy of which is available on request from the agents. 

METHOD OF SALE The land is being offered for sale by Informal Tender (unless sold prior), with a closing date of 12 noon on Friday, 16 December 2017.
