PLANNING CONSENT Permission under Class Q(a) & (b) of the Permitted Development Right regulations 2015 was granted by South Hams District Council on 30th July 2018 under reference 1903/18/PDM for the conversion of the Barn at Tally Ho Bridge into a residential dwelling. The consent gives Class Q approval for the conversion of the Barn at Tally Ho Bridge into a 3-bedroom, 2 bathroom dwelling together with open entrance hall, living room, kitchen/dining room and utility which provides a floor area of 225m².

The application was supported by detailed elevation drawings and floor plans together with a structural appraisal prepared by HB Surveying Ltd; however, these plans can be changed and prospective purchasers can submit a revised application to gain approval for the size and type of dwelling that they desire.

It will also be possible to insert a first floor/mezzanine into the building to further increase the floor area and, if desired, there is scope to increase the number of dwellings within the barn rather than converting it into a single dwelling.

It has also been recognised, in the Appeal decision Mansell v Tonbridge and Malling BC [2017] EWCA Civ 1314, that since a Class Q approval has been secured, this is a material planning consideration and can be used as a fall-back position for a future application for a replacement dwelling on the site of the Barn at Tally Ho Bridge. This, therefore, means that there is an opportunity for prospective purchasers to submit an application for an architecturally-designed dwelling to replace the Barn at Tally Ho Bridge on the site.

LITTLEHEMPSTON The hamlet of Littlehempston is situated just over a mile to the north east of Totnes. Located alongside the River Hems, a tributary of the Dart, and tidal up to Littlehempston Bridge, the village has a rural character, two pubs and its parish church of St John The Baptist. The village and surrounding countryside are within an area of great landscape value. Totnes is known as an Elizabethan town but has much earlier origins with a castle, a wonderful position on the River Dart and a main line railway station for quick access to Paddington. The town has a well-regarded community college, full range of shops, a weekly market and a wide choice of cultural facillites. The area is host to a variety of cultural, recreational and sporting pursuits: Dartmoor, the South Hams and the South Devon coastline are all within easy reach and both Exeter and Plymouth are within half an hour's drive. 

CONDITIONS The South Hams District Council hereby confirm PRIOR APPROVAL IS GIVEN for the proposed development at the address shown above, as described by the description shown above, and in accordance with the information that the developer provided to the local planning authority shown below: subject to the following conditions:
Conditions
1. The access widening works show non drawing 060318/03 shall be complete prior to the occupation of the residential unit hereby approved and thereafter retained in that format.

Reason: in the interest of road safety

2. If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, an investigation and risk assessment and, where necessary, a remediation strategy and verification plan detailing how this unsuspected contamination shall be dealt with.

Following completion of measures identified in the approved remediation strategy and verification plan and prior to occupation of any part of the permitted development, a verification report demonstrating completion of the works set out in the approved remediation strategy and the effectiveness of the remediation shall be submitted to and approved, in writing, by the local planning authority.

Reason: No site investigation can completely characterize a site. The condition is required to ensure that any unexpected contamination that is uncovered during remediation or other site works is dealt with appropriately.

3. The conversion of the existing barn shall be carried out in strict accordance with the recommendations set out within the structural report and the Schedule of Works, and there shall be no deviation from this.

Reason: For the avoidance of doubt this permission is for the conversion of the existing building.
