    What We Require

  • paragraph

    Marketing Your Property

Sales Particulars and Brochures -It is vital that your property is marketed with understanding and enthusiasm. Marketing material must be personalised, considered and of high quality to inspire greater confidence and encourage more viewings. We will prepare descriptive details, highlighting salient points and features. We pride ourselves on creating thoughtful property particulars and as such we are delighted to try to incorporate your ideas and comments. We will forward the draft details for approval. Floor plans provide prospective buyers with a useful understanding of the layout. We use quality wide angle cameras to take photographs in good weather conditions in order to showcase your property to its best advantage.

Email/Mail Out - We use a "state of the art" database system to co-ordinate matching and mailing of properties to potential buyers locally, nationally and internationally. Every suitable applicant will be sent details of your property by post or email. However, communication is all important and an enthusiastic phone call encouraging the "right" person to view is often the means to a successful sale. All our selling team will view and discuss your property so that each person will be confident and knowledgeable about what is being sold.

Website - Your property will reach buyers all over the world by being actively and strongly marketed across all of the major property website portals including Rightmove as well as our own new website www.heather-lay.co.ukThe vast majority of purchasers (probably over 80%) do their regular searching for property through the internet instead of buying newspapers or visiting agents. Our policy of embracing technology fully enables buyers to gain immediate access to not just a summary of the property, but a full description, complete with photographs and floor plans, creating their own brochure at the press of a button.

For Sale Board - A simple and effective marketing tool, advertising your property 24 hours a day and providing immediate recognition for prospective viewers and purchasers. We would strongly recommend that you have one.

The Office and Window Display - Your property details will be displayed in our prominent office in the middle of Falmouth and where applicable, within the windows of our very prominent Penryn office.Advertising - Although many of our purchasers live elsewhere in the country, or abroad, just over half of our sales are to local buyers. We are very well aware of the importance of local advertising and our high profile regional marketing attracts many buyers. We advertise regularly in the West Briton and Falmouth Packet and periodically in the national press, most specifically The Sunday Times and Saturday and Sunday Telegraph. We frequently have properties selected for editorial features in regional newspapers.

In House Publication - Your property will be featured in an edition of the Heather and Lay, Guild property magazine. This magazine generates a tremendous amount of interest. It is produced several times per year and is circulated countrywide.

We will review the marketing of your property on a regular basis until a suitable buyer is found.

  • paragraph

    Accepting An Offer And Conveyancing

Ultimately, it is your decision whether to accept an offer or not, however we will be with you every step of the way and can offer advice and guidance on the market to help you come to an informed decision.

Once you are happy with an offer, we will formally qualify the potential buyer, by asking them to provide the following information before we mark your property as being 'sold subject to contract':

    1. Photo identification and proof of address.

    2. An application in principle from a mortgage lender and their advisor's details, plus be qualified by our own independent financial advisor.

    3. We will require full proof of deposit.

    4. If your buyer is lucky enough to be purchasing with cash funds, we will ask to see full proof of the funds.

    5. If your buyer is relying on selling their own property, we will confirm the position of that sale and any linked sales to give you a full clear picture of the chain.

    6. We will request your buyer's solicitor details.

Once we have all the above, we will ask you for your solicitor's details. It is vital you choose the right solicitor who is ideally local, experienced and reliant as this will determine the success and smooth transition of the sale. We can recommend good, local, experienced solicitors; we deal with solicitors on a daily basis, and make our recommendations based on past experiences.

Once we have your solicitor's details, we will issue a memorandum of sale which is issued to all parties plus solicitors confirming the purchase price and any special conditions, a copy of your energy performance certificate will also be issued to the solicitors.

The conveyancing process takes approximately 8 to 12 weeks, and as there is no legal obligation on anyone until contracts are exchanged, it is important to act swiftly. Your solicitor is your main point of contact; he/she will keep you up to date and advise you on the legal side of the transaction. However, we will also be monitoring the sale, and we will update you on any information we obtain. Once the solicitors are in a position to exchange, your solicitor will negotiate and confirm completion dates with you, with a view to exchange and form a legally binding contract and setting a completion date in stone for you.

  • paragraph

    Completion
Your buyer's solicitor will transfer the remaining monies for the purchase of your property to your solicitor. Once your solicitor has received the monies, he/she will call you to confirm this, and then will call us to confirm we can legally hand the keys to your buyer. This all means the transaction is complete, and your buyer's are the new legal owners of the property. This transaction can happen at any time of the day, so we would advise you make arrangements to vacate as early as possible to avoid being there when your buyer's are trying to move in. We will liaise with you and your buyer to arrange the handover of keys.

What You Can Expect From Us
Our team understands that when it comes to buying what may be your biggest asset, you want to find the right property and have a smooth transition through the process. That is why we are determined to take a fresh approach to estate agency and surpass your expectations! You need to make an informed decision when buying your home, and with our experience we will guide you through every step of the way, giving you honest advice and up to date information. Below, we have set out a brief step by step guide from the very beginning to when you take you first steps through your new front door!
  • paragraph

What you can afford & arranging finances

Buying a property is a long term financial commitment, so you need to think about how much you want to pay for your mortgage each month, remembering to take into consideration income, financial commitments and outgoings.

It is recommended to apply for a mortgage 'in principle' before you start viewing properties, as you'll want a good idea of how much you can borrow and repayments. Finding the right mortgage can be lengthy, it is important that you speak to an Independent Mortgage Broker as well as your own bank; we would suggest obtaining three quotes.

We work very closely with a local broker whom we trust and believe to be very good at obtaining the 'right' product for buyers, he is able to explain things very well and his many years' experience in the industry provides him with knowledge to chase things through efficiently.

  • paragraph

    Having Your Offer Accepted

Once you have decided on the property you wish to buy, your offer will be made by us to the vendor, for their consideration. This is generally done both verbally and in writing. At this stage we will need to provide the vendor with information about your ability to proceed and finance the purchase of the property. All offers are "subject to contract" and therefore neither party is legally bound until the contract is exchanged.

You have found your dream property and your offer has been accepted!

We will guide you through the next stages carefully, answering any questions you have.

What we will need: Due to Money Laundering Regulations, we will ask you to provide for all buyers, photo identification, proof of address dated within the last 3 months, an application in principle from a mortgage lender and details of the financial advisor arranging your mortgage and proof of deposit/or full cash funds if applicable.

When your offer is accepted you should instruct a solicitor to act on your behalf. Your solicitor will handle all the legal requirements of your purchase. If you require a mortgage, you need to formally proceed with your mortgage application and instruct your mortgage consultant/broker accordingly.

Instructing a solicitor: Choosing an efficient solicitor will enhance the speed and success of your purchase. We can put you in touch with an experienced, local solicitor who we have no hesitation in recommending. Remember, we deal with a whole range of solicitors on a day to day basis, and we can give you unbiased advice about who to use for your conveyancing.

Applying for your mortgage: Your mortgage application will need to be submitted to the mortgage lender you have chosen. It is important that the mortgage lenders moves swiftly on instructing a mortgage valuation. Surveys: We recommend buyers should carry out a survey on their ideal property. If you are purchasing with a mortgage, your lender will carry out a basic mortgage valuation. However, you may want to have a more detailed report carried out such as a Homebuyer's Survey or Building Survey.

Valuation Survey - If you require a mortgage, the lender will instruct a chartered surveyor to carry out a mortgage valuation. The surveyor acts for the lender to provide a valuation which determines the amount to be loaned is secure and also deals with the basic condition of the property. As the buyer, you are provided with a copy allowing you to evaluate the findings.

Property Survey - You may wish to get a more in-depth survey which provides a more detailed report of the properties condition. There are two types of survey available:

    i. Homebuyers survey/valuation: This is more appropriate to properties which are in apparently good condition and conventionally constructed. The survey's purpose is to highlight any obvious or significant defects and problems which are likely to have an overall impact on the value of the property.

ii. Building Survey: This is suitable for all types of property whether conventional or unconventional in their construction. This survey is comprehensive and lists full technical details of the construction, materials and condition. It identifies all defects from the more serious down to the insignificant and the terms of the survey are therefore tailored to fit the client's specific needs.

Conveyancing Progression: The conveyancing process can take between 8 to 12 weeks. As there is no legal obligation on any party, until contracts are exchanged, it is advisable to move swiftly and choosing the right solicitor really makes the difference. We will monitor the progress of your purchase, giving you any updates we obtain, and we are always here to give you any assistance you may need.

Searches - Your solicitor will advise as to which searches are necessary. They will include:

    1. Local Authority - This search will give you information on a number of different areas e.g. planning issues, road works, the proximity of railway lines and whether the property is listed or in a conservation area.

    2. Water and Drainage - This search will reveal matters in relation to public sewers, mains water supply, surface drainage and connections.

    3. Other Conveyancing Searches - There are also some non-routine searches that need to be undertaken in certain circumstances.

Draft Contracts - The draft contract is drawn up by the seller's solicitor and is forwarded to the buyer's solicitor for consideration. Any additional queries or questions will be asked and answered and the contract amended accordingly, subject to final approval and signing by buyer and seller.

Mortgage Offer - The Lender is now in possession of the Mortgage Valuation survey and, subject to the findings of this report; receipt/approval of the mortgage application and provided all references and checks have been conducted satisfactorily, the Lender will send a formal mortgage offer to the buyer and their solicitor. The document is then signed and returned and funds requested by the buyer's solicitor.

Exchange Of Contracts - Once the contract has been signed by both parties, a deposit (normally 10% of the purchase price) is paid by either bank transfer or banker's draft. At this stage, the parties agree on a date for completion.

Completion - Completion usually follows a few days or weeks after exchange of contracts. The balance of the purchase price is transferred by the buyer's solicitor to the seller's solicitor and the keys released.

  • paragraph

Completion - You Can Have Your Keys!!!

The day has come, when you can finally have your keys! There are just a couple of formalities to go through, before we can legally hand you the keys. Your solicitor will transfer any remaining funds for the purchase to the vendors solicitor. When these funds are received and are cleared, the vendors solicitor will contact us to give us their permission for us to legally release the keys to you. At this point, the transaction is complete and you are the new legal owner!

This final part of the transaction can happen at any time of the day. We do ask that you be patient, and we will be in contact with you to arrange the handover of keys as soon as possible.
