    Landlords Guide

    Introduction -

    Letting your property can be a complicated process, one which many landlords have found to be a stressful and harrowing experience. We at ea2 aim to ensure that the letting and on going management of your property is dealt with in a professional and competent manner offering security and confidence.

    The notes contained herein are designed to answer some of the questions you may have. Alternatively we at ea2 are always available to offer advice and assistance for any queries that you may have.

    Fire and Safety Regulations -

    It is illegal to let a property containing items of furniture that do not comply with current safety requirements as laid out by The Furniture and Furnishings (Fire) (Safety) Regulations 1988 and The Furniture and Furnishings (Fire) (Safety) (Amendment) Regulations 1993. Any items of furniture older then 1950 are exempt from the above. Most items purchased from 1993 should comply but we at ea2 are able to advise should you have any queries.

    Gas Safety Certificates -

    It is illegal to let a property without a current Gas Safety certificate. Under The Gas Safety (Installation & Use) Regulations 1998 it is the landlord's responsibility to ensure all gas installations and appliances are maintained in safe working order. The Gas Safety certificate lasts 12 months and must be renewed whilst there is a tenant in the property. We at ea2 can recommend and organize a Gas Safety Registered Engineer should you require one.

    Electrical Safety -

    The Electrical Equipment (Safety) Regulations 1994 states that the landlord must ensure that all electrical appliances are safe and in good working order. A visual inspection of all electrical appliances should be carried out to ensure there are no obvious faults. We at ea2 can recommend and organize an EIC Registered Electrician to carry out an electrical test where upon the Landlord would receive a 12 month EIC certificate.

    Smoke/Carbon Monoxide Detectors

    It is a legal requirement to fit smoke detectors in rental properties. Smoke detectors should be fitted per floor of the property being let. It is also a legal requirement to fit carbon monoxide detectors for all solid fuel heating and hot water systems.

    Insurance -

    It is the landlords responsibility to ensure that the property and contents included within the let are insured. Items brought into the property by the tenants remain the tenants responsibility to insure.

    General -

    It is the landlords responsibility to pay any ground rent and or service charges relating to the let property. The tenant is however responsible for all utility charges including gas, electricity, water, telephone and council tax.

    If the property being let is subject to finance and the terms of this agreement require consent then you should obtain this consent prior to any tenancy.

    Again if the property is leasehold and requires consent to sub-let then this consent should be obtained prior to any tenancy.

    We recommend that you as a landlord set up a mail re-direction agreement with the post office. This will avoid any potential loss of mail.

    We should be supplied with the relevant sets of keys depending on the number of tenants moving in. We can have additional keys cut on your behalf with your permission. (Note : Under the Management Service we will require an additional set of keys for our use).

    Tenancy Agreements -

    We at ea2 only let properties using a standard Assured Shorthold Tenancy agreement as set under the Housing Act 1988, (As Amended 1996).

    Inventory -

    It is advisable to have an inventory of the furnishings and fittings of the property drawn up prior to any tenancy. This will confirm the furnishings and fittings and this condition prior to a tenants occupation. We use a professional inventory company to carry out all inventory report who are bonded by the AIIC, (Associated Independent Inventory Clerks). The landlord is responsible for the inventory report.

    Check In / Out -

    It is also advisable to carry out a check in when the tenant moves into the property. This will confirm the condition of the property on point of move in and then again when the tenant moves out. Again we use a professional inventory company to carry out all Check In / out reports who are bonded by the AIIC, (Associated Independent Inventory Clerks). The tenant is responsible for the Check In report whilst the landlord is responsible for the Check Out report.

    Finding a Tenant -

    We at ea2 will endeavour to find you the landlord a suitable tenant. Once we have agreed a monthly rent with you the landlord and the prospective tenant we will request 1 weeks rent from the prospective tenant to secure their interest and offer you some security. We will go through a series of formal procedures to verify a prospective tenant's suitability including referencing and credit checking. Please note that should the prospective tenant's references return un-satisfactory to the degree that would inhibit us in moving the tenant into the property then the prospective tenant would lose their deposit which would be forwarded to you the landlord in full. Ultimately the decision to accept a prospective tenant lies with you the landlord and should you wish to meet them prior to them moving in then we will of course arrange this.

    Deposit -

    We at ea2 request a damage deposit amounting to the equivalent of 6 weeks rent. In some instances a higher amount can be requested if the property being let has furnishings and fittings to warrant. The damage deposit is held against possible damage to furnishings and fittings during the duration of the tenancy period. The damage deposit is lodged with 'The Deposit Protection Service' as per legislation that was introduced in 2007 . Further information on this can be obtained from www.depositprotection.com

    EPC -

    From October 2008 the law applying to tenanted property changed and Landlords will have to provide Energy Performance Certificates for every property that they let.

    The EPC is being phased in across all residential, commercial and rented property. Only qualified domestic Energy Assessors (DEAs) can carry out the inspection and once complete an A to G rating will be applied to the property with recommendations to further improve internal efficiency.

    The new legislation regarding Energy Performance Certification (EPC) for rental property requires properties to have an EPC after the 1st of October 2008.

    Tenants Guide

    The London and Docklands rental market has grown in the last 2 decades with many properties bought for investment and subsequently released to the market for rental both short term and long term. Due to the growth of the City and Docklands arena, an increase in job availability has seen an increase in many local and overseas tenants requiring homes. For this reason the rental market is invariably a busy place with properties being agreed in days of coming to market. We at ea2 will assist you in your move throughout the process and as such ensure the move goes through in a professional and efficient manner.

    Stage 1 - Registering to rent.

    You can register either by phone, email or in person at our office. In any case one of our experienced property consultants will be able to register your details and start the search for your ideal property. Our property consultants will search for a property for you, understanding your property requirements, i.e. number of bedrooms, parking requirement, outside space, etc will assist us in finding you a property. We will also require a budget to work with, based on your requirements. You will be alerted to new instructions that come to market, at which point our dedicated team will arrange a suitable time with yourself and the owner to conduct a viewing. All viewings will be accompanied by one of our property consultants.

    Stage 2 - Making an Offer

    Once you have found a property that meets your requirements then the next step would be to register your interest. An offer can be put forward verbally to one of our property consultants but ideally to save any potential confusion confirmation of your interest and offer should be confirmed by email. Your offer should include clarification of your employment, desired move in date, term of tenancy and any other stipulation as example, professional clean.

    Stage 3 - Offer Agreed

    Once your offer has been accepted a holding deposit will be required, (typically 1 week depending on landlord) to remove the property from the market and to confirm your interest. We will also require a deposit receipt form to be signed, this confirms the proposed transaction and any conditions of let as per the original offer. All offers are subject to satisfactory references.

    Stage 4 - The Process

    Once we have an agreement in principle from the landlord, a holding deposit received and signed deposit receipt form then we can move forward with references. These are carried out by a reputable referencing agency and are completed online. The tenancy agreement will also be drawn up and issued to both yourself and the landlord for approval. In the mean time we will ensure that any conditions of let are completed, ready for the proposed move in. Once the references have been returned satisfactory we will organise a detailed inventory and check in to co-inside with the move in date. The inventory / check in report will detail the condition of the property and meter reading will be taken. This is carried out by a reputable inventory company who will release the report to you once completed for your approval. Upon or prior to move in we will require the tenancy agreement signed by all parties listed, the remainder of any funds cleared in our clients account and copies of passports of all parties listed.

    Stage 5 - Move In

    On move in you will be able to collect the keys to your new home from the office along with a congratulations!

Your solicitor/licensed conveyancer will carry out the local authority searches and if leasehold review the management pack and service charge accounts supplied by the sellers solicitors. Once they have obtained all the relevant information they will be in a position to report to you and your mortgage company if applicable. Whilst the legal process is under way the mortgage company will instruct a surveyor to carry out a valuation and survey. The surveyor will arrange with us access to the property. Once the surveyor has carried out the survey they will issue to you for your perusal. Providing the report is satisfactory the mortgage company will issue the mortgage offer to you and the mortgage instructions to your solicitor. This document confirms that the mortgage company is happy to lend to you for this particular property subject to your solicitor/licensed conveyancer supplying clean searches/clean title and full filling all their enquiries. Once the mortgage offer is released and your solicitor/licensed conveyancer have completed all their enquiries you will then be in a position to exchange contracts.       The transaction process can seem complicated and overwhelming at times. ea2 have employed a dedicated team to chase the transaction from offer agreed through to completion. We will update you regularly with the process and ensure that you are kept up to date with time frames and outstanding enquiries.

      Stage 7 - Exchange of Contracts

      Exchange of contracts is carried out by your solicitor/licensed conveyancer with the sellers solicitor/licensed conveyance. Upon exchange of contracts the transaction becomes legally binding between you the buyer and the seller and a completion date is set. Mortgage lenders normally require a minimum of 1 week to draw the funds down for completion.

      Stage 8 - Completion

      Completion takes place once your solicitor/licensed conveyancer receives the funds from the mortgage lender, (if applicable) and any other funds required from you for completion and forwards these to the sellers solicitor/licensed conveyancer. Once the sellers solicitor/licensed conveyancer has received the funds then the property has effectively changed hands and you are now the legal owner. We will receive confirmation from the sellers solicitor/licensed conveyancer of completion and instructions to release keys to you. Keys can be collected from our office along with congratulations.

      The transaction process can seem complicated and overwhelming at times. ea2 have employed a dedicated team to chase the transaction from offer agreed through to completion. We aim to both process the transaction in an efficient and speedy fashion and offer our services to both solicitors/licensed conveyancer on both sides in the assistance of the transaction. We will update you regularly with the process and ensure that you are kept up to date with time frames and outstanding enquiries.

      Stage 7 - Exchange of Contracts

      Exchange of contracts is carried out by your solicitor/licensed conveyancer with the sellers solicitor/licensed conveyance. Upon exchange of contracts the transaction becomes legally binding between you the buyer and the seller and a completion date is set. Mortgage lenders normally require a minimum of 1 week to draw the funds down for completion.

      Stage 8 - Completion

      Completion takes place once your solicitor/licensed conveyancer receives the funds from the mortgage lender, (if applicable) and any other funds required from you for completion and forwards these to the sellers solicitor/licensed conveyancer. Once the sellers solicitor/licensed conveyancer has received the funds then the property has effectively changed hands and you are now the legal owner. We will receive confirmation from the sellers solicitor/licensed conveyancer of completion and instructions to release keys to you. Keys can be collected from our office along with congratulations.

        Ea2, Wapping based Estate Agent has done a wonderful job. My property to sell was shared ownership flat so there are some more complication than the others. For start, they found a buyer very quickly -- after series of viewings -- and started a process immediately.         We went with EA2 because they seemed to really understand and know our area, and they were so lovely to deal with (more affordable and much nicer that some of the bigger agents we were speaking to).
