Tenants Guide to Renting

    Renting a property can be just as stressful as buying a home; the purpose to this guide is to offer some helpful advice and tips to ensure that your experience is a smooth and hassle free as possible.

    Before you start


    Before you start looking for a property to rent, it is important that you think about certain things first. You need to work out how much you can afford, the locations you would like to move to, the date you want to move into your new property, do you need furniture or have your own? This will all help you narrow down the properties that are worth viewing. Due to certain legislative changes, you will also need to find out if you have the right to rent a property in the United Kingdom.

    Viewings

    Much like buying a property, it is a good idea to break down what you want from a property into two lists - 'Essentials' and 'Would Likes'. You may find that you can compromise on certain aspects, such as paying a little more if it has everything you really want. In such a competitive market, it is also important that you act quickly if you find somewhere. Lettings is quite fast paced and as essentially a first come, first served basis. This means the first person to pay their holding fee, fill out the necessary paperwork and have their offer accepted by the landlords will be successful (subject to references).

    Offering

    Once you have viewed a property that you would like to proceed with you will fill out certain paperwork and pay a holding fee. The lettings negotiator will then put your offer forward to the landlord. You need to keep in mind that the answer may not be immediate, the landlord may need to speak to a business partner, husband/wife or another individual but we aim to get your offer agreed in the speediest yet secure way possible.

    Before paying any holding fee to the estate agent it is wise to ask several questions; Is it refundable? What is the referencing criteria? How will the deposit be protected? Are they a member of any redress scheme? How long will the tenancy be for? Who will be responsible for the council tax and utility bills? Who will be managing the property? What fixtures and fittings will remain in the property/be provided? Are there any rules or covenants you need to be made aware of? (Please note this list is not restrictive and there may be further questions to ask). If there are any requirements or things you would like done before you move into the property, you must ensure they are all expressed as part of your offer.

    Referencing

    Congratulations! Your offer has been accepted subject to passing the references. You should have asked your letting agent what the criteria for referencing is as different companies may have different policies. The most common is the have a good credit history, no CCJ's or bankruptcies, have a joint income equal or more than 2.5 times the annual rent of the property, and good landlord history. We go a little further and check your landlord history for the previous 3 years, employment history and will also perform 'Right to Rent' checks in accordance with current government legislation.

    If you are not quite earning enough there may be an opportunity for you to pay a larger amount of rent in advance or provide a guarantor. Please speak to your negotiator for further details.

    Contracts & Deposits

    Once the references have all passed you will then receive the fully composed contracts. You may be required to pop into the office and sign in person or you may be able to sign and scan/post the document back. At Kings, we do things slightly differently as we will use an online signing software to save you time and cut down on any inconvenience. The document is time and date stamped and legally binding.

    You will also be required to pay the agreed amount of rent and the deposit before you move into the property. Check, if not already done so, which government backed scheme the deposit will be held with and you should be issued with a certificate of registration after move in.

    Moving In

    When moving in, you will be issued with an inventory and schedule of condition. This is a thorough check on the property noting down in clear detail the condition of every aspect of the property including fixtures, fittings and furniture. You will need to look through this document, note down your comments and return it to us within 7 days. This is very important as we will use this inventory to compare the condition of the property for when you leave. You will also be issued with keys, a copy of your fully signed tenancy agreement, emergency contact number (if we manage the property) and other helpful information. You will also need to be provided with an energy performance certificate and a copy of the gas safety certificate.

    We will take meter readings before you move in but we always recommend that you take your own. You may also be able to change utility providers subject to approval by the landlord.

    Living In

    It is very important that you always pay your rent on time, if you don't you could lose your home as you have broken your tenancy agreement. If you are having problems, please do speak to your estate agent/landlord. You must look after the property and notify the property manager as soon as any issues arise, it is also worth getting your own contents insurance as the landlord's insurance will not cover your possessions. It is also important that you understand how to use the boiler and other appliances and know where the fuse box, stop cock and any meters are located.


    You need to be considerate to your neighbours or you could be evicted for anti-social behaviour; you are also unable to take in a lodger or sub-let without explicit permission from your landlord. You will also have regular inspections and the timings may vary depending on whether you are renting a HMO property or not.

    End of Tenancy

    At the end of your tenancy you may be offered to renew the tenancy for another fixed term, if your circumstances have changed you may need to be re-referenced. If you decide to vacate a check-out inventory will be performed with the purpose to see if any of the tenancy deposit needs to be deducted to cover any damages or cleaning costs. If you do not agree with any proposed deductions, please contact your letting agent to see if this can be resolved. If not, you will need to accept the charges or speak to the relevant deposit protection scheme. It is important that you ensure your rental payments are up to date as you are unable to hold back rent thinking it can be taken out of the deposit.


    Do not leave bills unpaid as this may have an impact on your credit rating and future references. Remove all your possessions and personal effects and if there was any furniture provided for you, you need to leave them in the positions and rooms they were initially in. You also need to leave the property in a clean state and it is advised you take metre readings before you return all the keys to your estate agent.

      Buying a property can be an incredibly stressful time; the purpose to this guide is to offer some helpful advice and tips to ensure that your experience is as smooth and hassle free as possible.
      What can you spend?


      Before you start searching for your first/next property, it is very important that you know how much you can spend. The best thing to do is speak to an independent financial advisor who has access to the entire marketplace. This way they can shop around to get you the best deal. Many buyers make the mistake of only going to their bank and often miss out on the best deal available to them. It is also important to remember that you will need to have additional funds to cover other expenses such as stamp duty, legal costs and removals.

      Searching


      When you decide to start searching for a property, you need to focus on what you really want. One of the most helpful ways to do this is to draw two columns with two headings; 'Essential' and 'Would Like'. You can then fill each column with relevant factors, you may find that these change during the course of your search and you compromise on things you thought you wouldn't be able to live without. One other thing to consider is the amount of work you would be willing to do on a property, are you open to building an extension or converting a loft (you will need to ensure you obtain the right permissions and approvals) or are you only looking to do minor cosmetic work such as painting?

      Registering to buy


      In such a competitive market and where properties are in such short supply it is important that you register with estate agents rather than just look online. If you see a property online, it may be too late. It is always a good idea to pop into the high-street agents so they can put a face to the name, this combined with regular contact will ensure that they think of you first when a new property comes to market, in some instances they will even be able to get you through the front door of a property that is not quite on the market yet.

      It is also important that you give the negotiator as much detail as possible for what you are looking for, inform them of what is on your 'Essentials' list and what you may be willing to compromise on.

      Viewings


      It is important that you view something as soon as you possibly can, chances are that if you are attracted to a property, somebody else will be too. We normally have keys for properties that we are selling and will try to be as flexible as possible with viewings but it is always wise to give us a selection of times where you would be available to view.

      Here at Kings, we always accompany viewings. This way an agent is on hand to answer any question you may have, whether it be about the property itself, the rental yield it may achieve or the surrounding areas, we are the local experts. If the property is a flat, you should always find out if it is leasehold or share of freehold as you would also need to ask the lease length, service charge and ground rent information.

      Submitting an offer


      We would urge you to make your offer as soon as you are certain that it is a property you really want to proceed with however, try not to delay as there may be other interested buyers too. We would require your offer to be submitted in writing and it must outline your offer price, financial details and buying position and have your mortgage in principle attached. We would also like you to speak to our independent financial advisor (you are not obliged to use them) to confirm your position so we can put your fully qualified offer forwards to our sellers with confidence.

      Offer accepted


      Congratulations! This is the first step to owning your new property, but the work doesn't stop here. We will write to all parties and both sets of solicitors in a document called the 'memorandum of sale'. This introduces the solicitors to each other and will also offer estimated exchange dates. It is important that your financial advisor submits your mortgage application to avoid delay. If you do not have any solicitors that you know of we are more than happy to recommend a selection to you, you are by no means obliged to use them though. We would always advise that you use a local solicitor as opposed to a 'call centre' type. Whilst the 'call centre' conveyancers can be cheaper they may not be able to help with certain aspects of the sale; after all, if you were going sky diving you wouldn't buy the cheapest parachute on the market, would you? You would pay a little more for the reliable one that gets the job done properly and efficiently.

      Surveys


      When buying with a mortgage you will be required to have a mortgage valuation conducted. This is so the mortgage lender can ensure their investment is safe. If you require a Homebuyers or Buildings Survey to be carried out, let your financial advisor know and they should be able to do that at the same time as the mortgage valuation. Alternatively, you could get an independent surveyor to carry out the Homebuyers or Buildings Survey. It is important to instruct a survey as soon as possible.

      Conveyancing


      Once the Memorandum of Sale has been received by both side's solicitors, the conveyancing process will start. You will be required to put them in funds so they can apply for searches and start working on your behalf. They will also raise enquiries for the seller and their solicitor to answer. If you are purchasing a leasehold property, your solicitor will confirm with them the lease details including service charge, ground rent and if there are any planned works.

      When both side's solicitors are satisfied, they will draw up a draft contract and your solicitor will send you a report outlining anything of importance or any agreements. If you are happy, you will be asked to sign and return the contracts and transfer your deposit to your solicitor in preparation for exchanging.

      Exchange


      By this point your solicitor will be in receipt of your signed contract, deposit and the fully signed mortgage offer sent through from your mortgage lender. Once this is the case the solicitors will 'exchange' which means that the transaction is now legally binding and a completion date will be set.

      Completion


      The balance of funds will be sent over to the vendor's solicitor and you now become the now legal owner of the property. Congratulations! We will give you a ring to let you know that you are now free to collect your keys!

With so many options of who to sell your home through these days Kings really did prove the value of a face to face service with the added expertise of local knowledge. I was kept up to date with every stage of the sale whether it was via an email or quick phone call. My house was sold literally within days so there can't be any question of Kings connections within the area. I would like to make particular note of the support both Nathan and Thomas provided throughout. Even when there was a issue or query which wasn't directly related to their involvement they made the time to talk it through with me and help in anyway they could. This support was invaluable in the stressful process of selling a house. I would recommend Kings to anyone who appreciates an estate agent that take a professional hands on approach to selling.
