Tenant Fees Act 2019 – Permitted Payments
Under the Tenant Fees Act 2019, the only payments that can be charged to a tenant are:
• Rent
• Refundable tenancy deposit
(capped at 5 weeks’ rent, or 6 weeks’ rent where annual rent exceeds £50,000)
• Refundable holding deposit
(capped at 1 week’s rent)
• Changes to the tenancy requested by the tenant
(capped at £50, or reasonable costs if higher)
• Early termination of the tenancy requested by the tenant
(costs must not exceed the landlord’s loss or reasonable agent costs)
• Payments for utilities, communication services, TV licence and council tax
(if not included in the rent)
• Default payments
(for late rent after 14 days interest is chargeable at 3% and replacement of lost keys/security devices is the cost of replacement and key cutting, where allowed in the tenancy agreement)
