    1. FIND OUT HOW MUCH YOU CAN AFFORD TO PAY

    Before getting too excited about a potential new home, speak to an independent financial adviser (we can recommend a local practice), as well as your personal bank/building society, to establish how much you can borrow. Mortgage deals and rates change regularly, and size of deposit and earning power will influence your choices greatly.

    2. BEGIN YOUR SEARCH OF HOUSES FOR SALE IN DEVON

    Our door at John Lake is always open to discuss your requirements and register your details on our mailing list, whilst our full register of properties and houses for sale in Devon is available on our personal website. Look in the local property guides including the Herald Express and view the national portals online for properties of interest.

    3. ARRANGE VIEWINGS

    Make notes if needed and assess both the negative and positive points. It is always wise to take a compass! Remember, no property is perfect so decide which attributes are most important and be realistic in achieving your ideal requirements for your budget when reviewing houses for sale in Devon...i.e. garden, parking, views, sunny aspect, level to amenities, close to a school etc.

    4. MAKE AN OFFER

    When a formal letter is required by a professionally qualified letting agent for assistance with a mortgage application. Many banks or building societies will insist on an ARLA registered member to produce a written valuation to confirm potential rental yield.

    Court of Protection

    When we would be called in to assess the value and correct method of sale in the disposal of a client's property when they are deemed to be no longer capable of handling their own affairs (under the Mental Health Act). This work must always be carried out to the letter, as we are basically working for a government department and they naturally have to be very specific on protocol and administration of the party's affairs.

    Private valuation

    Either to update the client on the value of their property or to assess the correct figure for fire/theft insurance.

    Auction and tender sales

    These are two methods used to sell properties but it is obviously of vital importance that the right properties are chosen. There is nothing worse than a failed public auction, but conversely nothing better than when several bidders are keen to buy and the final price reflects this. Our senior partner, John Lake, is our in house auctioneer and a fellow of the National Association of Auctioneers and Valuers.

    When a property is sold by public auction, provided the reserve price is surpassed, the fall of the 'hammer' is a legally binding contract for the sale between the seller and the buyer. At the time of the sale, the buyer signs the contract, which is exchanged on the day of the sale with usually a 10% deposit paid by the buyer. The completion date is inserted in the contract, which is typically 28 days from the day of sale.

    A sale by either 'informal' or 'formal' tender allows a specific timescale for marketing with a set time and date for sealed bids to be provided by ready and able purchasers. These forms of sale will give a degree of flexibility to the client as he or his administrators will be presented with a choice of buyers, probably all in differing circumstances. Then we would recommend the party that seems most secure - not always quite the highest figure, but the person most likely to complete the transaction. An acceptable offer with informal tender is not a legally binding exchange of contracts and the conveyance will progress similar to private treaty.

    A sale by formal tender will ensure all interest parties have access to the legal pack in advance and any surveys, valuations or mortgage applications should be undertaken prior to tender. The terms of sale will stipulate that an exchange of contracts will need to be within a swift timeframe, usually 5 working days from acceptance of tender, and if the terms are not adhered to the sellers can progress with another bidder.

Throughout his time with the company he has gained his Certificate of Practice in Residential Estate Agency and NVQ Levels II and III whilst also achieving the highly regarded Fellowship of the National Association of Estate Agents when he was 25, the youngest eligible age. Neil has also passed the Technical Award in Residential Lettings and Property Management and is a member of the Association of Residential Letting Agents (ARLA). A proud Torquay boy born and bred, Neil has extensive knowledge of the areas we cover and a true passion for the profession.

    Paul joined the firm at the start of 2015 and brings a wealth of experience, having been a household name in the local property market since starting his career at GA Property Services in 1992. He moved to Waycotts in 1995 where he progressed through the ranks to become an Associate Director, before joining Torbay Council in 2010 to work in a variety of roles involving housing and community safety. Throughout his career so far, Paul has achieved his NVQ Level III in Residential Property and Level 3 award in Domestic Energy Assessment through the National Association of Estate Agents of which he is a member. A Torquay boy born and bred with his roots firmly in the bay, Paul is a true professional with encyclopedic knowledge of both people and places.

    Gemma is Neil's better half and she keeps a trained eye on the accounts side of the businesses. Gemma worked at HMRC as a Revenue Officer for 7 years where she studied privately to gain her AAT Levels 3 and 4 qualifications. Gemma then joined the Lloyds Banking Group, moving to a highly regarded independent accountancy practice in Torbay before taking time off to have two beautiful children. Since 2011, Gemma has been working behind the scenes at John Lake yet she will be playing an integral part of the firm's future.

    Having been brought up in Devon's Exe Valley, John entered the profession in 1968 as an articled pupil with a large firm of auctioneers and valuers in Bristol where he progressed to establish a new office in Bath for the company before returning to Devon with his family in 1974. After furthering his career for 4 years with a local independent firm in Torquay, John started his own partnership in 1978 and is a Fellow of both the National Association of Estate Agents and National Association of Valuers and Auctioneers. Although John officially retired in March 2019, he remains actively involved with the company in an advisory capacity - still meeting with clients, he has amassed over 45 years in Torquay.
