The land is of a regular shape, level and with access to be provided directly off the realigned Moor Lane B1222. Outline Planning was granted for residential having been approved with completion of a Section 106 Agreement settled but has subsequently expired.


SITUATION:
The site is to the east of the village located off the realigned stretch of Moor Lane, the principle thoroughfare from the village eastwards AND towards the Industrial Estate and bounded to the east by the Sherburn Bypass where locally the roundabout gives ready access on A162 to the north, Tadcaster (York via A64) and south to the A1(M) Junction 44 and beyond M62 towards Leeds. To the north is the Bishop Dyke which bounds and recorded as an Environment Agency interest. Spring Drain forms the western boundary.

This is a very busy rural village, recently upgraded to a town status with generous available shopping, sporting and comprehensive amenities locally coupled with the extremely active 400 acre Industrial Estate in walking distance to the east of the village. A railway halt is local to the site with services from here and at South Milford to York, Selby, Hull & Doncaster with onward connections. A historic traffic count suggested 9,000 vehicle movements/day across the roundabout.

ACCESS:
The property has currently a 4.5m wide tarmacadam roadway directly from the Moor Lane. The provision of formal access rights is set out below under 'Rights'

It is contemplated that access improvements across the width and length and at the junction will be required subject to Sec 38 Agreement and North Yorkshire Highways approval.

SERVICES:
Mains water, gas and electricity are available locally but service connections will be required to be provided. Foul water is proposed as gravity discharging locally to a manhole close to the west of the site. Surface water drainage on site is suggested to a proposed balancing storage facility and pumped restricted discharge to Spring Drain, the IDB maintained ditch alongside and into Bishop Dyke to the north. Design work has been undertaken and results can be inspected at the office of the Agents. A site search has been completed and the plan annexed to these details

TERMS:
For sale by private treaty. Offers, full and final with or without conditions are invited for the 'yellow' site by 5.00pm Friday 28th October. Preference will be considered for proposed uses that have no requirement for taking up the Option for the 'Green' land.

PLANNING:
The site had an outline Planning consent approved under 2016/0359/OUT (expired) subject to a Section 106 Agreement which provides flexibility on 'Affordables' subject to a viability assessment.

It is considered the site may also have potential for retail PFS and supporting 'one stop' shopping opportunities with significant passing traffic counts and no other local competing facility.

CIL:
A Community Infrastructure Levy assessment will be due to be paid by the developer currently assessed at £45/m² for housing.


REPORTS:
A drainage report has been commissioned identifying surface water strategy. A geotechnical report has been obtained and can be inspected at the office of the Agent and which inter-alia provides a foundation formation assessment.

RIGHTS & RESERVATIONS:
The sellers have secured an Option of 3 years duration (to 1 Sept 2025) with North Yorkshire County Council providing for the acquisition of the woodland area identified in 'green' on the plan, exercisable on the payment in the sum of £200,000 plus costs; the said area subject to covenants that it be retained as wood, agricultural or amenity but permitting for the construction of a single vehicular access to the highway and a secondary footpath access. Any additional change of use of this 'woodland' is subject to an overage clause of 30 years duration providing for an additional payment of 50% of the enhancement.


The Environment Agency have statutory rights of access and control of matters and for cleaning the Bishop Dyke over a strip of 6 metres from the bank edge.

The Option agreement provides for access to the 'Green' strip for survey purposes.
