Hi Jan,

Thanks for the email and I hope you had a great holiday.

I can confirm that Adam has spoken to Mr James and advised him that we are to notify all prospective purchasers of the issues. He was not happy to be honest but I do feel that it is in everybody’s interests to be as transparent as possible.

The question mark we have however is over the drain in the kitchen which I believe Mr James has said he is investigating.

We have advised that we are going to pause viewings at this stage as we are a at a bit of a stalemate.

My honest professional advise is to move forward with modern method of auction which would mean a cut in asking price to reflect the works involved. Please let me know if you would like me to refer you to our auction specialist at I Am Sold.

I do feel it is going to be difficult for us to move forward at this stage with normal “Private treaty” sale as we could end up in the same position time and time again so don’t want to waste anyone’s time.

Hi Dan/Adam

Following on from our conversation earlier I am a concerned that you are not relaying to Mr James the importance of informing potential buyers of the known issues.

I am sure you are aware that 'Estate agents are legally obliged to notify potential buyers of any "material information" about a property that they are aware of, or should reasonably be aware of, as it could influence a buyer's decision to purchase" and failing to do so can lead to legal action.

The significant issues that have been identified once a survey has been completed are:

* No planning permission, steel calculations or building regs for the kitchen extension

* No build over agreement from Severn Trent to build over the foul man hole

* The log burner and the other open fires are not fitted with the correct lining and are unsafe to use

* The corrugated roof on the kitchen extension needs replacing.

Regardless of Mr James view on these issues potential buyers need to be informed, it is not my responsibility to proof that the foul man hole is active this has already been picked up on 2 separate surveys, so it is Mr James responsibility to prove that the foul man hole is redundant as Severn Trent have looked at the mapping and ensure me it is active.

I agree with you that until all potential problems listed above are addressed by Mr James or reflected in the asking price that no more viewings are to be considered.

Can you please confirm by return email your expert advice on how is best to proceed e.g. reduction in price or is the property more suitable to go into a modern auction.
