Description

As far as known the land is sold with the sporting rights, however a previous conveyance has reserved rights affecting a 15-yard-wide strip of land along most of the Eastern boundary. It is not known if these rights are exercised.

Clawback

The Land is being sold subject to an existing clawback clause.

The existing clawback clause is valid until 3rd April 2029 with a previous owner entitled to 50% of any uplift in value should the land be developed specifically in relation to residential, industrial, retail or commercial use only. 

The clawback provisions confirm that the use of the land for agriculture, horticulture or as pony paddock does not constitute a trigger event.

Future Clawback

The property will be subject to a new clawback clause which will be written into the contract.

The vendor shall be entitled to 30% of any uplift of the value of the land should a grant of planning permission be obtained during the period of 40 years commencing from the 4th April 2029 for any use other than agriculture, horticulture or use as pony paddocks.

Subsidy Scheme

The land is believed to be registered with the Rural Payments Agency and there are no Agri-environment scheme's in place on any of the land.

There are no public rights of way over the land as far as known.

The property is sold subject to any rights of way, wayleaves, rights, or easements which exist at the time of sale whether they are mentioned in these particulars or not.

Tenure

There is currently a Tenant in situ. The agreement will terminate on 30th September 2025.
