The land is classified as Grade 3 on the Land Classification Map for England and Wales. The land is accessed from the public highway directly off Chapel Field Road and secured by a locked gate. The soils are generally a heavy clay loam. The land comprises of four field parcels, all accessible from internal tracks and concrete pads. The Croppable Area of the property totals 77.69 acres (31.44ha). A schedule of land is found later in the particulars. The property includes areas of concrete which are included within the tenancy. Outgoings

Early Entry
The incoming Tenant may be permitted to enter the Holding before the commencement of the tenancy for the purpose of carrying out cultivations, subject to any reasonable limitations or restrictions specified by the outgoing Tenant, the current crop and straw being harvested and removed, and the tenancy documents having been signed.

Rights of Way
The land is not subject to any public footpaths or third party Rights of Way. The Landlord reserves a pedestrian and vehicular right of access to Sandham Plantation. Stamp Duty Land Tax
The incoming Tenant will be responsible for submitting the SDLT submission and will be responsible for paying all tax due.

Utilities and Infrastructure
The land is currently being considered as part of the Northern Endurance Partnership (NEP) - Humber Carbon Capture Pipeline, a proposed infrastructure project that will transport CO², captured from East Coast Cluster Carbon Capture projects in the Humber, to secure offshore storage in the North Sea. At present, the project is undertaking non-intrusive walkover surveys across the area being considered as the outgoing tenant and the landlord have signed a licence for non-intrusive surveys to be carried out up to 31st December 2025. The licence fee will be retained by the Landlord and the outgoing Tenant. The incoming Tenant will be required to meet the terms of the current licence and will be able to claim compensation for any losses incurred during the non-intrusive survey stage. If required by the NEP, the incoming Tenant will be required to enter into a new licence for non-intrusive surveys. It is likely that NEP will want to undertake intrusive surveys during the term of the tenancy. A licence for intrusive surveys will be negotiated between the Landlord, incoming Tenant and the scheme, within which compensation provisions will be covered. If the project progresses to the construction phase it will not be built until 2028 at the earliest based on the projects current time scales. Compensation provisions will be negotiated as part of this process. The incoming Tenant must not do anything that will jeopardise the Landlord´s position with regard to the proposed scheme.

TERMS
The land is to be let under a Lincolnshire Association of Agricultural Valuers Farm Business Tenancy Agreement subject to specific amendments and the following headline terms:
1) The term of the Farm Business Tenancy (FBT) will be for an initial three year fixed term from 1st October 2025 until 30th September 2028, before rolling on an annual periodic basis thereafter provided that neither party serves notice to terminate the tenancy.
2) Rent reviews to open market value and not less than every three years.
3) The rent will be payable quarterly in arrears on 31st December, 31st March, 30th June and 30th September in each year.
4) The Tenant shall be responsible for all outgoings.
5) The Tenant shall keep and leave in good repair all fences, gates, ditches, hedges, drains, roads, culverts
etc.
6) The Tenant may not assign or sublet the Tenancy.
7) The Tenant will use the land for arable production only. No livestock will be permitted without prior consent from the Landlord.
8) The Tenancy does not allow any genetically modified crops to be grown on the holding.
9) The Tenant will be responsible for insuring the growing crop and any produce or equipment temporarily stored on the holding.
10) There will be no consideration or allowance made whatsoever for any dilapidations or any other deductions upon entry.
11) Tenantright will be payable to the outgoing tenant where rights have been reserved.
12) The Landlord reserves the right to keep all wayleave payments made in respect of the land.
13) A Record of Condition will be completed prior to entry and will form part of the Tenancy agreement.
