Tenure - Lease of the site to operate a catering and water sports hire business.

Introduction.
Torbay Council invites offers from parties interested in entering into a Lease for the right to place a catering unit at Torre Abbey Sands, Torquay and to operate a water sports hire business in conjunction with the catering unit. The Lease will be offered for a period of 5 years with the opportunity to benefit from seasonal trade (as defined below). The Lease is to include the terms and conditions outlined in this document.

Location.
Situated in Torquay adjacent to the beach with close proximity to a number of hotels, theatre and restaurants, the area is very popular with holiday makers during the summer season, and locals all year round. The site for the catering unit will be on the public walkway above the stepped revetments to the beach at Torre Abbey Sands shown edged red on plan no. EM4355 for identification purposes only. The precise location is to be agreed between the parties; however Torbay Council reserves the right to finally determine the exact location.
The Water sports rights will provide the Lessee with the opportunity to hire to the public a range of non-motorised recreational boats, kayaks, floats, pedal boats etc, owned by the Lessee. The number, range and model of water sports crafts offered to be agreed in advance with the Landlord.

Interested parties are free to view the location at their leisure.

Rateable Value / Street Trading Permit.
The Site does not currently hold a rating assessment, and the potential rating liability would depend on the nature of the catering unit proposed. The Lessee shall be responsible for the payment of any business rates that may become due during the period of their Lease, therefore we advise all interested parties to check with the Local Authority's non-domestic rates department in respect of their specific intentions.

Planning
This opportunity is subject to a planning application in progress for similar arrangements to previously granted temporary permission. Subject to Torbay Council's prior approval as Landlord, interested parties may obtain planning consent in the event the site does not benefit from planning consent at commencement of the lease for any reason. Torbay Council reserve the right to withdraw from this lease in the event planning consent is not obtainable.
