Applicants should also note that the Live/Work Lease will not be subject to the provisions introduced by the Renters' Rights Bill, including open-ended tenancies or the statutory ability to challenge rent increases in the same manner as residential tenancies.

Whilst the Lease may otherwise fall within the Landlord and Tenant Act 1954, the provisions of Sections 24 to 28 of that Act will be formally excluded. Prior to completion, the successful applicant will be served with a Notice in the prescribed form set out in Schedule 1 of the Regulatory Reform (Business Tenancies) (England and Wales) Order 2003.

Before the commencement of the tenancy, the incoming tenant will also be required to sign a Statutory Declaration, confirming their understanding of the Live/Work arrangements. This declaration must be witnessed by a solicitor authorised to administer oaths. The process is straightforward, usually taking only a few minutes, and typically costs approximately £10.
