DESCRIPTION
An exciting opportunity to acquire an initial five-year Farm Business Tenancy Agreement of 27.11 Hectares
(66.99 Acres) or thereabouts of productive Grade II and Grade III agricultural land situated in and around
Kirkby Green near Lincoln.

The land comprises of five enclosures, each with good access from internal farm tracks. All of the parcels are
suitable for modern agricultural machinery. A copy of the Field Plan is shown attached to these Particulars (for
identification purposes only and not to scale).

The land is being offered to let by Informal Tender. Informal Tenders are to be received by 12 Noon on Friday 21st August 2026. for the attention of Richard Start or Alice Peach, The Agricultural Department, 5 New Road, Spalding, Lincolnshire, PE11 1BS.

LAND AND SOILS CLASSIFICATION:
The Land Classification Map of England and Wales has recorded the land to be a combination of Grade II and Grade III Agricultural Land. The land is further classified as being of the Beccles 1 Association of Soils which is further classified as slowly permeable seasonally waterlogged fine loamy over clayey soils and similar soils with only slight seasonal waterlogging. Some calcareous clayey soils especially on steeper slopes.

METHOD OF LETTING:
The land is offered To Let as a whole by Informal Tender. The closing date for Tenders is 12 noon on Friday 31st July 2026. Tenders are to be submitted on the enclosed Tender Form and returned to Richard Start or Alice Peach, The Agricultural Department, 5 New Road, Spalding, Lincolnshire, PE11 1BS, in a sealed envelope marked "Arable Land in and around Kirkby Green, Lincoln´

TENANCY:
The land is offered To Let on an initial five-year fixed term Farm Business Tenancy Agreement with a commencement date of 11th October 2026. The Tenancy will be produced on a Lincolnshire Association of Agricultural Valuers Farm Business Tenancy Agreement, a copy of which is available from the Lettings Agents upon request.

RENT, INSURANCE & VAT:
Rent will be payable half yearly in advance, the first payment will be due on the signing of the Tenancy Agreement. Rent will thereafter be payable on 6th April and 11th October in each year. VAT is currently not payable on the rent. In the event that the property or any part thereof, any rights, contracts, quotas or Entitlements become chargeable supply for the purpose of VAT, any such taxes will be payable in addition to the rent at the appropriate rate. Rent reviews will be in accordance with the default terms of the provisions of the Agricultural Tenancies Act 1995. The Tenant(s) will be responsible for having Public Liability Insurance in place to a suitable level.

It will be the responsibility of the Tenant to also obtain their own machinery, crop, contents insurance and public liability insurance. The Tenant will keep the Landlord´s fixed equipment insured to a suitable value.

ACCESS:
All of the land benefits from access via shared internal farm tracks. The shared internal farm tracks are accessed directly off the public highway via locked gates. A maintenance contribution is payable by all users of the access track which is charged ´as and when required.´ It will be the responsibility of the incoming Tenant to cover any costs associated with this.

SERVICES:
It is believed that there are no services connected to any of the land however interested parties should make any enquiries with the relevant utility provider.

EARLY ENTRY:
Early entry to the land may be possible, subject to the Farm Business Tenancy being completed and the first instalment of rent being paid. Early Entry will be at the risk of the incoming Tenant(s).

DRAINAGE RATES:
The Tenant(s) will be responsible for the payment of the annual Drainage Rates to the Witham First Internal Drainage Board, and the Environment Agency.

VIEWING:
Interested parties are invited to walk the land during daylight hours with a copy of these Particulars to hand and should, at all times, for their own personal safety, take appropriate precautions to ensure that no damage occurs either to themselves or to the land, or any part thereof.

PLANS, AREAS & SCHEDULES:
These Particulars and Plans have been prepared as carefully as possible. It should be noted that the Plans have been specifically prepared ´for identification purpose only´ and, although believed to be correct, their accuracy is not guaranteed. The areas have been taken from a combination of the Rural Payments Agency´s Rural Land Register and the Ordnance Survey Promap System.

BOUNDARIES:
The successful tenant shall be deemed to have full knowledge of all boundaries.

MAINTENANCE:
The Tenant will be responsible for the maintenance of the Holding (s) to include the internal farm tracks, trees, hedges and dykes (in conjunction with the Internal Drainage Board where appropriate).

TENANT RIGHT, DILAPIDATIONS & HOLDOVER:
Tenant right may be chargeable at the commencement of the tenancy. More details are available from the Letting Agents. There will be no claim allowed whatsoever for dilapidations (if any) at the commencement of the tenancy, but dilapidations will be charged if appropriate at the end of the tenancy.

CONTRACTS AND QUOTAS:
There are no contracts or quotas available with the letting.

SPORTING RIGHTS:
The Sporting Rights are to be excluded from the letting.

SUB-LETTING:
The Landlord permits the Tenant to sub-let no more than 20% of the total land within the Farm Business Tenancy Agreement in each year of the Agreement for the growing of agricultural crops only.

BASIC FARM PAYMENT & ENVIRONMENTAL SCHEMES:
The Basic Payment Scheme De-Linked Payment has been claimed and will be retained by the out-going Occupier. The land is not currently entered into any Environmental Schemes.

Going forward, the incoming Tenant may enter the land into a future scheme, subject to receiving the Landlord´s prior written consent, consent not to unreasonably be withheld. The term of any new stewardship agreement must not exceed the term of the Farm Business Tenancy Agreement. It should be noted that the Landlord will only permit future stewardship options that do not change the permanent land cover of the parcel.

RIGHTS OF WAY, WAYLEAVES AND EASEMENTS ETC:
The land is let subject to, and offered with the benefit of, all existing rights, including rights of way, whether public or private, light, support, drainage, water, electricity, and other rights, easements, quasi-easements, and all wayleaves, whether referred to specifically in these particulars or not. The Landlord will retain any wayleave payments in respect of the farm. We are not aware of any Public Rights of Way which affect the land.

NITRATE VULNERABLE ZONE:
All of the land parcels fall within a Nitrate Vulnerable Zone being the Lower Witham NVZ (Surface Water) further information is available from the Lettings Agent - Richard Start or Alice Peach.

SOIL TESTING:
If requested by the Landlord, Soil testing (to include P, K, Magnesium, pH, Organic Matter) and a soil health report is to be undertaken at the commencement of the tenancy, with the cost shared equally between landlord and tenant. The tenant is to maintain the soil on the Holding in a healthy condition throughout the tenancy. Similar testing will be undertaken prior to the end of the tenancy (again cost shared equally) with the tenant responsible for the cost of remediating any shortfall in soil fertility, nutrient content, or condition, by reference to the original report.
