NEW ASSURED PERIODIC TENANCIES – TENANT FEES AND CHARGES
**Applicable to new assured periodic tenancies entered into on or after 1 May 2026**
Holding Deposit – One Week’s Rent
A refundable holding deposit of up to **one week’s rent** may be taken to reserve a property while the necessary pre-tenancy checks are completed.
The holding deposit may be retained where permitted by law, including where a relevant person (including any guarantor) withdraws from the proposed tenancy, fails a Right to Rent check, provides materially significant false or misleading information, or fails to enter into the tenancy agreement within the agreed Deadline for Agreement.
The statutory default Deadline for Agreement is **15 calendar days**, unless a different period is agreed in writing between the parties.
Where a holding deposit is lawfully retained, the landlord or agent must provide the prospective tenant with written reasons within the statutory timescale.
Security Deposit – Annual Rent Under £50,000
A refundable tenancy deposit of up to **five weeks’ rent** may be taken where the annual rent is less than £50,000.
The deposit is held as security against losses or defaults arising under the tenancy and must be protected in accordance with the applicable tenancy deposit protection requirements.
Security Deposit – Annual Rent of £50,000 or More
A refundable tenancy deposit of up to **six weeks’ rent** may be taken where the annual rent is £50,000 or more.
The deposit is held as security against losses or defaults arising under the tenancy and must be protected in accordance with the applicable tenancy deposit protection requirements.
The Tenant Fees Act limits the maximum deposit to six weeks' rent where the annual rent is between £50,000 and £100,000.
Unpaid Rent
Where permitted by the tenancy agreement and applicable legislation, interest may be charged on rent that remains unpaid for more than **14 days** at a rate of **3% above the Bank of England Base Rate**.
Lost Keys or Other Security Devices
Tenants are liable for the **reasonable and evidenced cost** of replacing lost keys or other security devices.
Where the loss results in locks needing to be changed, the tenant may be charged the reasonable actual cost of the locksmith, replacement lock and replacement keys required for the tenant, landlord or any other authorised keyholder.
Any additional charge for the time spent arranging or carrying out the replacement will be limited to the reasonable cost actually incurred and must be supported by appropriate evidence.
Variation of Contract – Tenant’s Request
**Up to £50.00 (including VAT) per agreed variation**, or the reasonable costs incurred if those costs are higher and can be evidenced.
This covers the reasonable costs associated with taking the landlord’s instructions and preparing and executing any necessary legal documentation.
Change of Sharer – Tenant’s Request
**Up to £50.00 (including VAT) per replacement tenant**, or the reasonable costs incurred if those costs are higher and can be evidenced.
This covers reasonable costs associated with taking the landlord’s instructions, referencing the proposed replacement tenant, carrying out Right to Rent checks, updating deposit records and preparing and executing any necessary legal documentation.
Tenant Requests to End the Tenancy
As new assured periodic tenancies do not have a fixed contractual end date, a tenant may normally end the tenancy by giving the required notice.
A tenant may also request to leave before the expiry of their required notice period. Where the tenant does not provide the correct notice, the landlord may charge an amount equivalent to the rent that would otherwise have been payable during the required notice period, subject to the limits imposed by the Tenant Fees Act 2019 and the terms of the tenancy.
The amount charged must not exceed the rent that would have been payable had the tenant given the required notice.
The landlord and tenant may also agree in writing to end the tenancy earlier.
